Will Modern Water Tanks be in the Ruling of Flowing Water?

بسم الله الرحمن الرحيم

Nowadays, in most cities, there is generally a pipe system for water to reach into the bathrooms of the houses. Its system of usage is such that the pumps on the bored wells are turned and from it, the water reaches the tanks. Then from these tanks, the water is released to different places.

If impurity falls into the tank when its water is flowing from both sides i.e. water is being pumped from the well on one side [of the tank] and it is being released out [of the tank] on the other side, through a pipe, to the baths, toilets, etc., then according to the majority of the noble jurists, in this case, since the tanks would be in the ruling of flowing water, it will not become impure until one of the three qualities of the water, its colour, taste or smell changes.

However, if the impurity fell into the tank at a time when the water was flowing from both sides but the impurity remained therein after the water was shut off from any one side, or it fell in at such a time that the tank’s water was not flowing from both sides, or it was shut from any one of the two sides, for instance, the water is being pumped from the well [to the tank] but it is not being released [on the other side], or it is coming out at the other end but not being pumped up from the well, rather only the water that is already present in the tank is coming out, then in these cases, if this tank is less than 10 x 10 [dhira’], which is equivalent to 225 sq. ft in our times, then it will become impure since the tank would be in the ruling of a small body of water. However, if it is 10 x 10 [dhira’] then it will be in the ruling of a large body of water. So, it would not be considered impure, after the impurity has fallen into it until one of the three attributes of its water does not change.
