Question:
If the bus-driver does not stop the bus on the road to perform salah, will one sit and perform salah in the bus or make qadhaa of salah?
Answer: حامدا ومصليا ومسلما

Performing salah in a bus is valid. Facing qiblah and standing is necessary. If it’s not possible, then sit and perform it with ruku and sajdah or by signs. However (in the last two cases) repeat the salah afterwards.

(وقالا ) أي أبو يوسف ومحمد رحمهما الله تعالى ( لا تصح ) جالسا ( إلا من عذر وهو الأظهر ) لحديث ابن عمر أن النبي صلى الله عليه و سلم سئل عن الصلاة في السفينة فقال ” صل فيها قائما إلا أن تكون تخاف الغرق ” وقال مثله لجعفر ولأن القيام ركن فلا يترك إلا بعذر محقق لا موهوم

( و ) إذا كانت سائرة ( يتوجه المصلي فيها إلى القبلة ) لقدرته على فرض الاستقبال ( عند افتتاح الصلاة وكلما استدارت ) السفينة ( عنها ) أي القبلة ( يتوجه ) المصلي باستدارتها ( إليها ) أي القبلة ( في خلال الصلاة )

It is mentioned in ‘Jadeed Fiqhi Masaail’:

Buses are made in such a manner that if the bus is not facing qiblah then it’s not possible to face qiblah. In such a case if the bus is stopped, then come out and perform salah. If one is not able to stop the bus,then one may perform salah without facing the qiblah. [Jadeed Fiqhi Masaail Vol.1 Pg.128 Naeemiyah Deoband]

It is mentioned in ‘Ahsanul Fatawa’:

Perform salah standing and facing qiblah in a bus or train. [..] If it is not possible to stand and face qiblah then perform salah by signs and repeat it afterwards.  [Ahsanul Fatawa 4:88 Fatawa Mahmoodiyah Mubawwab Farooqiyah Vol.5 Pg.524]

It is mentioned in ‘Bahrur Raaiq’:

أن العذر إن كان من قبل الله تعالى لا تجب الإعادة وإن كان من قبل العبد وجبت الإعادة

[If an excuse is from Allah, then repetition (of the salah) in not wajib. If an excuse is from the servant, then repetition is necessary.]

It is mentioned in ‘Sharh Munyah’:

والمقيد اذا صلى قاعدا لعدم قدرته على القيام بسبب القيد يعيد اذا زال ذلك السبب.

[When the prisoner performs salah sitting since he is not able to stand due to being imprisoned, he will repeat his salah when that cause ceased to exist.] [Sharh Munyatil Musalli Pg.76 Suhail]
