Question:
Bakr gave Zaid ten eggs to incubate under his hen on the condition that the chicks would be shared equally. Is this permissible?
Answer: حامدا ومصليا ومسلما
This is not permissible. However this contract may be made permissible by Bakr selling Zaid five eggs and then remitting the cost.
وَالْحِيلَةُ فِي جِنْسِ هَذِهِ الْمَسَائِلِ أَنْ يَبِيعَ صَاحِبُ الْبَيْضَةِ نِصْفَ الْبَيْضَةِ وَصَاحِبُ الدَّجَاجَةِ نِصْفَ الدَّجَاجَةِ مِنْ الْمَدْفُوعِ إلَيْهِ وَيُبَرِّئَهُ عَنْ ثَمَنِ مَا اشْتَرَى فَيَكُونُ الْخَارِجُ بَيْنَهُمَا. كَذَا فِي الْمُحِيطِ.
