Question:
A certain man is abusive to his wife, forcing her, being extremely harsh and physically beating her. To save her life, this woman retreats to her parent’s home without the permission of her husband and her parents refuse to send her (back to the husband’s home). So, is the woman, or her parents, wrong in this regard?
Answer: حامدا ومصليا ومسلما
In this particular case, according to Shari’ah, the person on the wrong and the sinner is the husband for hitting his wife without justification and punishing her without right. In such a case, it is not disobedience or insubordination on the part of the woman to go to her parents’ house because this emergence is not without right or reason, but rather justified.
