Laws of Surah Baqarah V.222-223

بسم الله الرحمن الرحيم

وَيَسۡـَٔلُونَكَ عَنِ ٱلۡمَحِيضِ‌ۖ قُلۡ هُوَ أَذً۬ى فَٱعۡتَزِلُواْ ٱلنِّسَآءَ فِى ٱلۡمَحِيضِ‌ۖ وَلَا تَقۡرَبُوهُنَّ حَتَّىٰ يَطۡهُرۡنَ‌ۖ فَإِذَا تَطَهَّرۡنَ فَأۡتُوهُنَّ مِنۡ حَيۡثُ أَمَرَكُمُ ٱللَّهُ‌ۚ إِنَّ ٱللَّهَ يُحِبُّ ٱلتَّوَّٲبِينَ وَيُحِبُّ ٱلۡمُتَطَهِّرِينَ (٢٢٢) نِسَآؤُكُمۡ حَرۡثٌ۬ لَّكُمۡ فَأۡتُواْ حَرۡثَكُمۡ أَنَّىٰ شِئۡتُمۡ‌ۖ وَقَدِّمُواْ لِأَنفُسِكُمۡ‌ۚ وَٱتَّقُواْ ٱللَّهَ وَٱعۡلَمُوٓاْ أَنَّڪُم مُّلَـٰقُوهُ‌ۗ وَبَشِّرِ ٱلۡمُؤۡمِنِينَ

“They ask you about menstruation. Say: “It is an impurity. So, keep away from women during menstruation; and do not have intimacy with them until they are cleansed. But when they are cleansed, then go to them from where Allah has commanded you. Surely Allah loves those who are most repenting, and loves those who keep themselves pure. (222) Your women are tillage for you to cultivate. So, come to your tillage from where you wish, and advance something for yourselves, and fear Allah, and know that you are to meet Him, and give good news to the believers.” (223)

Ruling: As in regards to the menstruation of females and what should be at that period of time, Allah says that menstruation is a filth so he commands to leave having intercourse with them during the period of menstruation. He commands that we should not come near to them for sexual intercourse until they become pure. The Messenger of Allah ﷺ said, “Whoever engages in sexual intercourse with a menstruating woman, or a woman in her anus, consults a soothsayer, then he has disbelieved in what was revealed to Muhammad.” (Tirmithi 135, Muslim 302)

Ruling: According to Imam Abu Hanifah, if 10 days pass from the start of the period, then he can have intercourse with his wife without her taking a shower, but if it ends any time less than 10 days for example, her habit was six days and she ended on the sixth day, he cannot have intercourse with her until she takes a ghusl or a prayer timing passes. If a woman’s normal period was seven or eight days and the flow of blood stopped after six, she will have to wait until the termination of the seventh or eighth days and then sexual intercourse will be permissible. (Tafsir Uthmani V1 pg 233)

Ruling: One does not need to totally leave one’s wife for this duration like the Jews did, he can still eat, drink, live with, and even sleep in the same bed as her in this period of time, even being intimate is permissible as long as one refrains from the area between the naval and the knee. (Tafsir Uthmani V1 pg 233) Rather this verse was revealed to refute the practice of the Jews. (Muslim 302) Aisha RA reports that, “When anyone amongst us (amongst the wives of the Holy Prophet ﷺ) menstruated, and the Messenger of Allah ﷺ intended to embrace her, he would ask her to tie a lower garment (over her body) during her menses and then he would embrace her. And who among you can control his desire as the Messenger of Allah ﷺ used to control his desire. (Bukhari 302, Muslim 293)

Ruling:  In verse 223 Allah gives permission to enter the wife’s front private part from any position so desired, whether it be standing, sitting, laying down, from the front or from the back. (Tafsir Jalalayn V1 pg 139)

Ruling:  Women were compared to soil, and the man as the cultivator, this shows that sexual intercourse is not just for lustful reasons, but also as a way to have children. This hints towards the fact that anal intercourse is forbidden because it is not a productive act and no cultivation of children is involved. (Maarif Al Quran V1 pg 561)
