Question:

My Umrah is simply voluntary. It is not wajib or manzoor (of an oath). It is simply that in my heart I wish to see the House of Allah and visit the blessed Rawdha of the Nabi. My brothers also promised to arrange the travel expenses. Will performing Hajj then become Fardh on me? Neither does this servant has the means of the expenses for Hajj at the moment, nor does it seem possible in the future.

Answer: وبالله التوفيق

After Umrah, if you have enough finances to reside there until the days of Hajj and there is no governmental obstacle, then Hajj would be Fardh (compulsory) on you.

If, however, you do not posses the financial means to reside there until the days of Hajj or there is a governmental obstacle, then in such a case Hajj will not become Fardh simply by performing Umrah.

الفقير الآفاقي إذا وصل إلى الميقات صار كالمكي. فيجب عليه والم يقدر على الراحلة. (فتح ولباب) و ينبغي ان يراد به الفقير المتنفل لنفسه ليخرج الفقير المامور, فانه اذا وصل الى الميقات لا يصير كالمكي, لان قدرته بقدرة غيره, وهي لا تعتبر, فلا يجب عليه الخ. (غنية الناسك 18 ادارة القران كراتشي)

مستفاد: والحاصل أن الزاد لا بد منه ولو لمكي كما صرح به غير واحد كصاحب الينابيع و السراج … الفقير الآفاقي إذا وصل إلى ميقات فهو كالمكي. قال شارحه أي حيث لا يشترط في حقه إلا الزاد و (لا) الراحلة. (شامي 4:488-459 زكريا)

قال الرافعي في قوله : الا الزاد والراحلة, لعل فيه حذف “لا” النافية قبل “الراحلة” مع حذف العطف. (تقريرات الرافعي 156, احسن الفتاوى 4:529)
