Who is a Khunth\u0101?<\/strong><\/span><\/p>\n

A khunth\u0101<\/em> is such a person who has both a penis and a vagina.<\/span><\/p>\n

The Criterion For Stipulating the Gender of a Non-B\u0101ligh<\/strong> <\/span>Khunth<\/span>\u0101<\/strong><\/span><\/p>\n

If one of the following occurs and not the opposite, the gender can be stipulated:<\/span><\/p>\n

    \n
  1. If he urinates from his penis, he is a male.<\/span><\/li>\n
  2. If she urinates from her vagina, she is a girl.<\/span><\/li>\n
  3. If it urinates from both organs, the organ which dispenses the urine first will be considered.<\/span><\/li>\n<\/ol>\n

    If it comes out from both organs at the same time it will be considered a khunth\u0101 mushkil.<\/em><\/span><\/p>\n

    The Criterion For Stipulating the Gender of a B\u0101ligh<\/strong> Khunth\u0101<\/strong><\/span><\/p>\n

    In the following situations it will be classified as a male:<\/span><\/p>\n

      \n
    1. A beard emerges.<\/span><\/li>\n
    2. He gets a wet dream as men experience.<\/span><\/li>\n
    3. He has intercourse with a woman.<\/span><\/li>\n<\/ol>\n

      In the following situations, it will be classified as a female:<\/span><\/p>\n

        \n
      1. Growth of breasts.<\/span><\/li>\n
      2. Milk is produced in her breast.<\/span><\/li>\n
      3. She sees \u1e25ay\u1e0d. <\/em><\/span><\/li>\n
      4. She becomes pregnant. OR<\/strong><\/span><\/li>\n
      5. It is possible to have intercourse in her vagina.<\/span><\/li>\n<\/ol>\n

        If after reaching the age of maturity (15 lunar years or 14 years 6 months of the solar calendar) none of the above occur or some signs of both genders occur, then it will be considered a khunth\u0101 mushkil<\/em>.<\/span><\/p>\n

        Laws of the Khunth\u0101<\/strong><\/span><\/p>\n

          \n
        1. If the khunth\u0101 <\/em>was established as a male, all the laws pertaining to men will apply to him.<\/span><\/li>\n<\/ol>\n

          E.g. He will stand in the male\u2019s row in \u1e63al\u0101h<\/em> and will be the bread winner for the family, etc.<\/span><\/p>\n

            \n
          1. If the khunth\u0101 <\/em>was established as a female, all the laws pertaining to women will apply to her.<\/span><\/li>\n<\/ol>\n

            E.g. She will pray with the ladies and wear \u1e25ij\u0101b<\/em> etc.<\/span><\/p>\n

            If the gender was not<\/strong> established rather, it was considered a khunth\u0101 mushkil<\/em>, the most severe laws of each gender will apply ihtiy\u0101\u1e6dan<\/em><\/strong> (out of caution).<\/span><\/p>\n

            \u0627\u0644\u0627\u0635\u0644 \u0641\u064a \u0630\u0644\u0643 : \u0627\u0646 \u0627\u0644\u062e\u0646\u062b\u0649 \u0627\u0644\u0645\u0634\u0643\u0644 \u06cc\u0624\u062e\u0630 \u0644\u0647 \u0641\u064a \u062c\u0645\u06cc\u0639 \u0627\u0645\u0648\u0631\u0647 \u0628\u0627\u0644\u0627\u062d\u0648\u0637<\/strong> \u0641\u064a \u0627\u0645\u0648\u0631 \u0627\u0644\u062f\u06cc\u0646\u00a0<\/span><\/p>\n

            Laws of the Khunth\u0101 Mushkil<\/strong><\/span><\/p>\n

              \n
            1. The khunth\u0101 mushkil<\/em> will have to be circumcised.<\/span><\/li>\n
            2. If it was circumcised when it is a minor, then both a male or female doctor can perform the surgery.<\/span><\/li>\n
            3. If it is b\u0101ligh<\/em> then a male doctor cannot be used since there is a possibility that the khunth\u0101 mushkil<\/em> is a woman.<\/span><\/li>\n<\/ol>\n
                \n
              • A female doctor cannot be used since it may be a male.<\/span><\/li>\n
              • Hence, the Fuqah\u0101\u2019<\/em> state that the khunth\u0101 mushkil<\/em> should purchase a female-slave who will then conduct the operation.<\/span><\/li>\n
              • If it cannot afford her then its father should purchase the slave.<\/span><\/li>\n
              • If his father also cannot afford one then the state will purchase one for it, and after she conducts the operation, she will be resold and the monies replaced in the treasury.<\/span><\/li>\n<\/ul>\n
                  \n
                1. It will have a separate row between the rows of the men and women in jam\u0101\u02bfat \u1e63al\u0101h<\/em> (congregational prayers).<\/em><\/span><\/li>\n
                2. Based on the Mu\u1e25\u0101dh\u0101t Mas\u2019alah<\/em> in \u1e63al\u0101h<\/em> the following will apply:<\/span><\/li>\n<\/ol>\n
                    \n
                  • If it performs \u1e63al\u0101h <\/em>in the men\u2019s row, the men on its right and left will have to repeat their \u1e63al\u0101h<\/em> because it is possible that it is a woman. Therefore, the \u1e63al\u0101h <\/em>of the men on its right and left will be invalid due to mu\u1e25\u0101dh\u0101t<\/em>.<\/span><\/li>\n
                  • If it performs \u1e63al\u0101h <\/em>in the women\u2019s row, it has to repeat its \u1e63al\u0101h <\/em>since it is possible that it is a man and by performing \u1e63al\u0101h <\/em>beside a woman it has invalidated its own \u1e63al\u0101h<\/em>.<\/span><\/li>\n<\/ul>\n
                      \n
                    1. It should wear a khim\u0101r<\/em> in \u1e63al\u0101h <\/em>because if it is a woman, \u1e63al\u0101h <\/em>in a top\u012b <\/em>will not be valid.<\/span><\/li>\n<\/ol>\n

                      N.B.<\/strong> The repetition of \u1e63al\u0101h <\/em>in the above mas\u0101\u2019il<\/em> will be musta\u1e25ab <\/em>if the khunth\u0101 mushkil<\/em> is a minor and w\u0101jib<\/em><\/strong> if it is b\u0101ligh<\/em><\/strong>.<\/span><\/p>\n

                        \n
                      1. It will be makr\u016b\u1e25 ta\u1e25rim\u012b<\/em><\/strong> (reprehensible) for it to wear silk and jewellery.<\/span><\/li>\n
                      2. In front of women its \u02bfawrah <\/em>will be that of a man.<\/span><\/li>\n
                      3. In front of men its \u02bfawrah<\/em> will be that of a woman.<\/span><\/li>\n
                      4. It is not allowed to be in seclusion with both, a non-ma\u1e25ram<\/em> man or a non-ma\u1e25ram woman.<\/em><\/span><\/li>\n
                      5. It is not allowed to travel without a male ma\u1e25ram<\/em>.<\/span><\/li>\n
                      6. In \u1e24ajj<\/em> it will wear sewn clothing like a woman but pay the penalty of jin\u0101yah<\/em> like if it was a man who had covered.<\/span><\/li>\n
                      7. If it performs \u1e24ajj<\/em> when it was a minor,<\/u> then there will be no<\/u> penalty even though it will wear the women\u2019s clothing.<\/span><\/li>\n
                      8. It is not allowed to be present at the bathing and shrouding of a dead man or woman.<\/span><\/li>\n
                      9. When it dies, no male or female will bathe it. Rather tayammum <\/em>will be performed.<\/span><\/li>\n
                      10. It will be shrouded in five cloths like a woman.<\/span><\/li>\n
                      11. If it dies along with a man and a woman then when lining them up for jan\u0101zah \u1e63al\u0101h<\/em>, the male will be closest to the Im\u0101m and the khunth\u0101 mushkil <\/em>will be placed further towards the qiblah<\/em> and then the woman will be placed.<\/span><\/li>\n
                      12. When burying it, a cloth will be placed over its grave as done with a woman.<\/span><\/li>\n
                      13. In inheritance, Im\u0101m Ab\u016b \u1e24an\u012bfah considers it a woman in most scenarios and a male in a few.<\/span><\/li>\n<\/ol>\n

                        N.B.<\/strong> In the fiqh<\/em> books the scholars use the masculine pronoun for the khunth\u0101 mushkil<\/em>. However, in English we have a neutral pronoun \u201cit\u201d.<\/span><\/p>\n

                        A Story of Im\u0101m Ab\u016b \u1e24an\u012bfah\u2019s Wit:<\/strong><\/span><\/p>\n

                        When the non-b\u0101ligh khunth\u0101<\/em> urinates from both organs at the same time:<\/span><\/p>\n

                          \n
                        • \u1e62\u0101\u1e25ibayn<\/em> held the opinion that the organ from which most of the urine emerges will be taken into consideration.<\/span><\/li>\n
                        • This is based on the principle: \u0644\u0644\u0627\u0643\u062b\u0631 \u062d\u0643\u0645 \u0627\u0644\u0643\u0644. The law is based on the majority.<\/span><\/li>\n
                        • When Ab\u016b Y\u016bsuf mentioned this to Im\u0101m Ab\u016b \u1e24an\u012bfah, he immediately retorted: \u201cAnd which judge is going to sit there with a utensil and weigh the urine?\u201d<\/span><\/li>\n<\/ul>\n

                          And All\u0101h Ta\u02bf\u0101l\u0101 knows best.<\/strong><\/span><\/p>\n
