(i.e., by <em>ni\u1e63\u0101b<\/em>: 3 -10 days OR by law: if it goes over 10 days. In this case, it will be considered to have ended within 10 days based on her previous habit.)<\/span><\/p>\n<p style=\"text-align: justify;\"><span style=\"color: #ff00ff; font-family: 'book antiqua', palatino, serif;\"><strong>Age of \u201closing hope\u201d for \u1e24ay\u1e0d and Nif\u0101s (i.e., Menopausal Age)<\/strong><\/span><\/p>\n<ul style=\"text-align: justify;\">\n<li><span style=\"font-family: 'book antiqua', palatino, serif;\">Lunar: 55 years. [<span style=\"color: #339966;\"><strong>Preferred Opinion<\/strong><\/span>]<\/span><\/li>\n<li><span style=\"font-family: 'book antiqua', palatino, serif;\">Solar: 53 years 4 months.<\/span><\/li>\n<\/ul>\n<p style=\"text-align: justify;\"><span style=\"font-family: 'book antiqua', palatino, serif;\">See <a href=\"https:\/\/www.fiqhulislam.com\/menopause-at-30-years-of-age-an-exception\/\">here<\/a> regarding an exception of 30-year-old menopause.<\/span><\/p>\n<p style=\"text-align: justify;\"><span style=\"font-family: 'book antiqua', palatino, serif;\"><strong>N.B.<\/strong><\/span><\/p>\n<ul style=\"text-align: justify;\">\n<li><span style=\"font-family: 'book antiqua', palatino, serif;\">There is <strong>no<\/strong> age limit for <strong><em>isti\u1e25\u0101\u1e0dah<\/em><\/strong><em>.<\/em> <span style=\"font-size: 10pt;\">[<em>Z\u0101d-ul Mutazawwij\u012bn<\/em>]<\/span><\/span><\/li>\n<li><span style=\"font-family: 'book antiqua', palatino, serif;\">If a woman spots <strong>after<\/strong> 55 years and it does <strong>not<\/strong> reach the <em>ni\u1e63\u0101b <\/em>(of 3 days), it is <strong><em>isti\u1e25\u0101\u1e0dah<\/em><\/strong>.<\/span><\/li>\n<\/ul>\n<p style=\"text-align: justify;\"><span style=\"font-family: 'book antiqua', palatino, serif;\"><span style=\"color: #ff0000;\"><strong>Rule 1:<\/strong><\/span> When a woman reaches the age of <strong>55 <\/strong>and her bleeding <strong>stops<\/strong>, the judgement of her being in <strong>menopause <\/strong>is passed.<a href=\"#_ftn1\" name=\"_ftnref1\">[1]<\/a><\/span><\/p>\n<p style=\"text-align: justify;\"><span style=\"font-family: 'book antiqua', palatino, serif;\"><span style=\"color: #ff0000;\"><strong>Rule 2: <\/strong><\/span>The <strong>\u02bf<em>iddah<\/em><\/strong> (for a divorce) of a woman who reaches the age of 55 and is no longer seeing blood is counted as <strong>3 lunar months<\/strong>.<\/span><\/p>\n<p style=\"text-align: justify;\"><span style=\"font-family: 'book antiqua', palatino, serif;\"><strong>N.B. <\/strong>\u00a0<strong>\u02bf<em>Iddah<\/em><\/strong> is:<\/span><\/p>\n<ul style=\"text-align: justify;\">\n<li><span style=\"font-family: 'book antiqua', palatino, serif;\"><strong>3 lunar months<\/strong> (based on moonsighting even if it turns out to be 29 days): If the divorce occurs on the <strong>1<sup>st<\/sup> of the month<\/strong>.<\/span><\/li>\n<li><span style=\"font-family: 'book antiqua', palatino, serif;\"><strong>90 days<\/strong>: If the divorce occurred on <strong>other than<\/strong> <strong>the 1<sup>st<\/sup><\/strong> of the month.<\/span>\u00a0[<em style=\"font-family: 'book antiqua', palatino, serif; font-size: 10pt;\">Raddul Mu\u1e25t\u0101r<\/em><span style=\"font-family: 'book antiqua', palatino, serif; font-size: 10pt;\"> 10\/280]<\/span><\/li>\n<\/ul>\n<p style=\"text-align: justify;\"><span style=\"font-family: 'book antiqua', palatino, serif;\">See <a href=\"https:\/\/www.fiqhulislam.com\/how-are-the-3-lunar-months-counted-for-%ca%bfiddah\/\">here<\/a> for details regarding how the 3 lunar months are counted.<\/span><\/p>\n<p style=\"text-align: justify;\"><span style=\"font-family: 'book antiqua', palatino, serif;\"><span style=\"color: #ff0000;\"><strong>Rule 3: <\/strong><\/span>If she did <strong>not<\/strong> reach 55 years but she stops seeing blood (menses\/<em>isti\u1e25\u0101\u1e0dah<\/em>):<\/span><\/p>\n<ul style=\"text-align: justify;\">\n<li><span style=\"font-family: 'book antiqua', palatino, serif;\">Even though she is considered to be in menopause <strong>clinically\/medically, <\/strong>she is considered to be in <strong><em>\u1e25ay\u1e0d<\/em><\/strong> and the judgement of <em>iy\u0101s <\/em>(menopause) is <strong>not<\/strong> passed<strong> legally in the <em>Shar\u012b\u02bfah<\/em><\/strong>.<\/span><\/li>\n<li><span style=\"font-family: 'book antiqua', palatino, serif;\">Thus, if she is divorced, her <em>\u02bfiddah <\/em>will be counted as <strong>3 <em>\u1e25ay\u1e0d<\/em> periods<\/strong>. (i.e., she needs to see 3 periods in order to complete her \u02bf<em>iddah<\/em>.)<\/span><\/li>\n<li><span style=\"font-family: 'book antiqua', palatino, serif;\">However, she is no longer seeing her periods so for her <em>\u02bfiddah<\/em> to be completed, she has to:<\/span><\/li>\n<\/ul>\n<ol style=\"text-align: justify;\">\n<li><span style=\"font-family: 'book antiqua', palatino, serif;\">Remain in <em>\u02bfiddah <\/em>until she is 55.<\/span><\/li>\n<li><span style=\"font-family: 'book antiqua', palatino, serif;\">After she turns 55, spend 3 lunar months more in <em>\u02bfiddah<\/em>.<\/span><\/li>\n<\/ol>\n<p style=\"text-align: justify;\"><span style=\"font-family: 'book antiqua', palatino, serif;\"><strong>N.B. <\/strong>This ruling is difficult; it elongates her <em>\u02bfiddah<\/em> period. Therefore, if a woman is finding it unbearable to remain in <em>iddah<\/em> for such a long period or she fears she may fall into sin, then:<\/span><\/p>\n<p style=\"text-align: justify;\"><span style=\"font-family: 'book antiqua', palatino, serif;\">Th\u0101nv\u012b states that she must first try <em>e\u02bfl\u0101j<\/em> (take medication to induce the <em>\u1e25ay\u1e0d<\/em>). Once she sees 3 <em>\u1e25ay\u1e0d<\/em> regardless of the colour of blood, she will exit the \u02bf<em>iddah<\/em>. Only if she is not successful in this will she try the following:<\/span><\/p>\n<ul style=\"text-align: justify;\">\n<li><span style=\"font-family: 'book antiqua', palatino, serif;\">Ask a <em>M\u0101lik\u012b Q\u0101\u1e0d\u012b <\/em>to issue a verdict of one year\u2019s \u02bf<em>iddah<\/em>. (There is a weak opinion of 9 months as well).<\/span><\/li>\n<li><span style=\"font-family: 'book antiqua', palatino, serif;\">If a <em>M\u0101lik\u012b Q\u0101\u1e0d\u012b <\/em>not available, then acquire a verdict from a <em>\u1e24anaf\u012b Q\u0101\u1e0d\u012b<\/em>.<\/span><\/li>\n<li><span style=\"font-family: 'book antiqua', palatino, serif;\">If a <em>\u1e24anaf\u012b Q\u0101\u1e0d\u012b <\/em>is not available, then acquire a verdict from a <em>Shar\u02bf\u012b <\/em>Council<em>.<\/em><\/span><\/li>\n<li><span style=\"font-family: 'book antiqua', palatino, serif;\">If none of the above available, then get a <em>fatw\u0101<\/em> from a<em> \u1e24anaf\u012b Muft\u012b <\/em>according to the <em>M\u0101lik\u012b <\/em>opinion of one year.<\/span><\/li>\n<\/ul>\n<p style=\"text-align: justify;\"><span style=\"font-family: 'book antiqua', palatino, serif; font-size: 10pt;\">[<em>Raddul Mu\u1e25t\u0101r<\/em> 10\/270, 277, 279, 280] [Imd\u0101dul Fat\u0101w\u0101 Jad<span style=\"font-family: 'book antiqua', palatino, serif;\">\u012b<\/span>d 5\/393]\u00a0 [Kif\u0233atul Muft\u012b 6\/401] [A\u1e25sanul Fat\u0101w\u0101 5\/435]<\/span><\/p>\n<p style=\"text-align: justify;\"><span style=\"font-family: 'book antiqua', palatino, serif;\"><span style=\"color: #ff0000;\"><strong>Rule 4<\/strong>:<\/span> A woman is <strong>not<\/strong> 55 as yet and is nursing her child and she is no longer seeing <em>\u1e25ay\u1e0d<\/em> (i.e, she is <em>mumtad \u1e6duhr<\/em>). So, her <em>\u02bfiddah<\/em> will be counted as <strong>3 <em>\u1e25ay\u1e0d<\/em> periods<\/strong>. Her <em>\u02bfiddah<\/em> will <strong>not<\/strong> end by the passing of 3 lunar months based on the original ruling.<\/span><\/p>\n<p style=\"text-align: justify;\"><span style=\"font-family: 'book antiqua', palatino, serif;\">If she takes medication to induce her <em>\u1e25ay\u1e0d<\/em> and even if she sees yellow discharge during the days of <em>\u1e25ay\u1e0d,<\/em> it will be considered as <em>\u1e25ay\u1e0d<\/em> and her <em>\u02bfiddah <\/em>will be counted by it and will be terminated by the passing of 3 such <em>\u1e25ay\u1e0d <\/em>periods.<\/span><\/p>\n<p style=\"text-align: justify;\"><span style=\"color: #3366ff; font-family: 'book antiqua', palatino, serif;\">\u201cAccording to The Womanly Art of\u00a0<strong>Breastfeeding<\/strong>\u00a0(p. 364-366), almost all mothers who are fully\u00a0<strong>breastfeeding<\/strong>\u00a0their babies are free of menstrual periods\u00a0<strong>for<\/strong>\u00a03 \u2013 6 months or longer. This is called lactational amenorrhea.\u201d<\/span><\/p>\n<p style=\"text-align: justify;\"><span style=\"font-family: 'book antiqua', palatino, serif;\"><strong>N.B.<\/strong> Since many women experience this, the <em>fuqah\u0101\u2019 <\/em>specifically mentioned a suckling woman. <strong>Otherwise, this ruling applies to all women who have very long <em>\u1e6duhrs<\/em> or stopped seeing <em>\u1e25ay\u1e0d<\/em> before 55 years of age.<\/strong><\/span><\/p>\n<p style=\"text-align: justify;\"><span style=\"color: #ff0000; font-family: 'book antiqua', palatino, serif;\"><strong>Rule 5: <\/strong><\/span><\/p>\n<ul style=\"text-align: justify;\">\n<li><span style=\"font-family: 'book antiqua', palatino, serif;\">If after 55 years, a woman sees pure blood (dark black\/red in colour), and it reaches the <em>ni\u1e63\u0101b <\/em>(of at least 3 days \/72 hours) it <strong>is<\/strong> considered as <strong><em>\u1e25ay\u1e0d<\/em><\/strong>. (<span style=\"color: #339966;\"><strong>This is the preferred opinion<\/strong><\/span>.)<a href=\"#_ftn2\" name=\"_ftnref2\">[2]<\/a><\/span><\/li>\n<li><span style=\"font-family: 'book antiqua', palatino, serif;\">If she bleeds for less than the <em>ni\u1e63\u0101b <\/em>(less than 72 hours) even if it stops 1 minute before the <em>ni\u1e63\u0101b<\/em>, then it is <strong>not<\/strong> considered as <em>\u1e25ay\u1e0d<\/em>.<\/span><\/li>\n<\/ul>\n<p style=\"text-align: justify;\"><span style=\"color: #0000ff; font-family: 'book antiqua', palatino, serif;\"><strong><u>Scenario:<\/u><\/strong><\/span><\/p>\n<ul style=\"text-align: justify;\">\n<li><span style=\"font-family: 'book antiqua', palatino, serif;\">A woman does not see blood for a couple years (for e.g., 3 years) after the age of 55.<\/span><\/li>\n<li><span style=\"font-family: 'book antiqua', palatino, serif;\">Then, when she\u2019s 58, she bleeds (dark red\/black in colour) for 3 full days or more, it is considered as <em>\u1e25ay\u1e0d<\/em>.<\/span><\/li>\n<li><span style=\"font-family: 'book antiqua', palatino, serif;\">However, if she bleeds for less than 3 full days, it is not considered as <em>\u1e25ay\u1e0d<\/em>.<\/span><\/li>\n<\/ul>\n<p style=\"text-align: justify;\"><span style=\"font-family: 'book antiqua', palatino, serif;\"><strong><span style=\"color: #ff0000;\">Rule 6<\/span>: <\/strong>If she sees other than pure blood (dark black \/red in colour). For instance, she sees blood that is brown, yellow or muddy in colour:<\/span><\/p>\n<p style=\"text-align: justify;\"><span style=\"font-family: 'book antiqua', palatino, serif;\"><strong>Opinion 1<\/strong>: <strong>Birgiv\u012b<\/strong>: The restriction of pure blood (dark red\/black) indicates that if she does not see pure blood (brown, yellow, muddy in colour) for 3+ days it is <strong>not<\/strong> <em>\u1e25ay\u1e0d<\/em>. Rather, it is <strong><em>isti\u1e25\u0101\u1e0dah<\/em>. <\/strong><\/span><\/p>\n<ul style=\"text-align: justify;\">\n<li><span style=\"font-family: 'book antiqua', palatino, serif;\">Their reasoning for this being <em>isti\u1e25\u0101\u1e0dah<\/em> and not <em>\u1e25ay\u1e0d<\/em>:<\/span><\/li>\n<\/ul>\n<p style=\"text-align: justify;\"><span style=\"font-family: 'book antiqua', palatino, serif;\">This is omitted by the restriction \u201cflowing from the womb\u201d as these colours do not come out from the womb.<\/span><\/p>\n<p style=\"text-align: justify;\"><span style=\"font-family: 'book antiqua', palatino, serif;\"><strong>Opinion 2:\u00a0 \u02bf<em>All\u0101mah<\/em> Sh\u0101m\u012b<\/strong> in \u201c<em>Raddul Mu\u1e25t\u0101r\u201d mentions<\/em>:<\/span><\/p>\n<p style=\"text-align: justify;\"><span style=\"font-family: 'book antiqua', palatino, serif;\">This ruling is actually based on what her habit was before menopause (55 lunar years):<\/span><\/p>\n<ul style=\"text-align: justify;\">\n<li><span style=\"font-family: 'book antiqua', palatino, serif;\">If before the age of 55, her <em>\u1e25ay\u1e0d<\/em> habit was dark red or black, then after 55, if she sees yellow, brown or muddy coloured blood it will <strong>not<\/strong> be <em>\u1e25ay\u1e0d,<\/em> rather it will be<strong> <em>isti\u1e25\u0101\u1e0dah<\/em><\/strong>.<\/span><\/li>\n<li><span style=\"font-family: 'book antiqua', palatino, serif;\">If before the age of 55, her <em>\u1e25ay\u1e0d<\/em> habit was yellow, brown or muddy in colour, after 55, if she sees yellow, brown or muddy coloured blood for 3+ days, it <strong>will<\/strong> be <strong><em>\u1e25ay\u1e0d<\/em><\/strong> and <strong>not <\/strong><em>isti\u1e25\u0101\u1e0dah<\/em>.<\/span><\/li>\n<li><span style=\"font-family: 'book antiqua', palatino, serif;\">If before the age of 55, her <em>\u1e25ay\u1e0d<\/em> habit was as blood in clots, after 55 if she sees blood in clots for 3+ days, it <strong>is<\/strong> considered as <strong><em>\u1e25ay\u1e0d<\/em><\/strong>.<\/span><\/li>\n<\/ul>\n<p style=\"text-align: justify;\"><span style=\"font-family: 'book antiqua', palatino, serif;\"><strong>N.B: This is the more correct opinion. <\/strong><\/span><\/p>\n<p style=\"text-align: justify;\"><span style=\"font-family: 'book antiqua', palatino, serif; font-size: 10pt;\">(Also see: <em>Kit\u0101bul Mas\u0101\u2019il<\/em> by Muft\u012b Salm\u0101n Mansurpur\u012b Vol.1 Pg.233)<\/span><\/p>\n<p style=\"text-align: justify;\"><span style=\"color: #ff0000; font-family: 'book antiqua', palatino, serif;\"><strong>Rule 7:<\/strong><\/span><\/p>\n<ul style=\"text-align: justify;\">\n<li><span style=\"font-family: 'book antiqua', palatino, serif;\">If a woman sees blood (dark red\/black\/other habitual colour) <strong>after<\/strong> 55 years, the ruling of <strong>not<\/strong> being in <strong>menopause<\/strong> will <strong>only<\/strong> be passed regarding the <strong>future<\/strong> and <strong>not<\/strong> the past.<\/span><\/li>\n<li><span style=\"font-family: 'book antiqua', palatino, serif;\">Thus, the <em>nik\u0101\u1e25 <\/em>that was initiated after her <em>\u02bfiddah <\/em>but before the blood returned does <strong>not<\/strong> become invalid.<a href=\"#_ftn3\" name=\"_ftnref3\">[3]<\/a><\/span><\/li>\n<\/ul>\n<p style=\"text-align: justify;\"><span style=\"color: #0000ff; font-family: 'book antiqua', palatino, serif;\"><strong><u>Scenario explaining this ruling:<\/u><\/strong><\/span><\/p>\n<ul style=\"text-align: justify;\">\n<li><span style=\"font-family: 'book antiqua', palatino, serif;\">A woman is 55 + years old and is considered to be in menopause.<\/span><\/li>\n<li><span style=\"font-family: 'book antiqua', palatino, serif;\">She is then divorced.<\/span><\/li>\n<li><span style=\"font-family: 'book antiqua', palatino, serif;\">So, her <em>\u02bfiddah<\/em> is counted as 3 lunar months or 90 days as mentioned previously.<\/span><\/li>\n<li><span style=\"font-family: 'book antiqua', palatino, serif;\">After these 3 months of \u02bf<em>i<\/em><em>ddah<\/em> have passed, she marries another man.<\/span><\/li>\n<li><span style=\"font-family: 'book antiqua', palatino, serif;\">After this 2<sup>nd<\/sup> marriage, she now sees dark black\/red or another colour that was her habit for at least 3 days.<\/span><\/li>\n<\/ul>\n<p style=\"text-align: justify;\"><span style=\"color: #ff0000; font-family: 'book antiqua', palatino, serif;\"><strong>Solution:<\/strong><\/span><\/p>\n<ul style=\"list-style-type: disc; text-align: justify;\">\n<li><span style=\"font-family: 'book antiqua', palatino, serif;\">This is considered as <em>\u1e25ay\u1e0d<\/em>.<\/span><\/li>\n<li><span style=\"font-family: 'book antiqua', palatino, serif;\">This means that she is no longer in menopause.<\/span><\/li>\n<li><span style=\"font-family: 'book antiqua', palatino, serif;\">This ruling (of not being in menopause) will only apply to the future and not the past.<\/span><\/li>\n<\/ul>\n<p style=\"text-align: justify;\"><span style=\"font-family: 'book antiqua', palatino, serif;\">The ruling is not applied to past. Therefore:<\/span><\/p>\n<ol style=\"text-align: justify;\">\n<li><span style=\"font-family: 'book antiqua', palatino, serif;\">After her divorce, counting her <em>\u02bf<\/em><em>iddah<\/em> as 3 lunar months is a valid <em>\u02bf<\/em><em>iddah<\/em>.<\/span><\/li>\n<li><span style=\"font-family: 'book antiqua', palatino, serif;\">Her 2<sup>nd<\/sup> marriage is a valid <em>nik\u0101<\/em><em>\u1e25<\/em>.<\/span><\/li>\n<\/ol>\n<p style=\"text-align: justify;\"><span style=\"font-family: 'book antiqua', palatino, serif;\">The ruling is applied to the future. Therefore:<\/span><\/p>\n<ol style=\"text-align: justify;\" start=\"3\">\n<li><span style=\"font-family: 'book antiqua', palatino, serif;\">If she is then divorced by this 2<sup>nd<\/sup> husband, her <em>\u02bf<\/em><em>iddah<\/em> will be now counted as 3 <em>\u1e25<\/em><em>ay<\/em><em>\u1e0ds.<\/em><\/span><\/li>\n<\/ol>\n<p style=\"text-align: justify;\"><span style=\"font-family: 'book antiqua', palatino, serif;\"><span style=\"color: #ff0000;\"><strong>Rule 8:<\/strong><\/span> If she counts her <em>\u02bfiddah<\/em> by months. Then:<\/span><\/p>\n<ul style=\"text-align: justify;\">\n<li><span style=\"font-family: 'book antiqua', palatino, serif;\">She saw blood of <em>\u1e25ay\u1e0d<\/em> <strong>before<\/strong> the completion of the 3 lunar months, she has to <strong>restart<\/strong> the counting of her <em>\u02bfiddah<\/em> as<strong> 3 <em>\u1e25ay\u1e0d<\/em> periods<\/strong>.<\/span><\/li>\n<li><span style=\"font-family: 'book antiqua', palatino, serif;\">She saw blood of <em>\u1e25ay\u1e0d<\/em> <strong>after<\/strong> the completion of the 3 lunar months, she does <strong>not<\/strong> have to restart the counting of her <em>\u02bfiddah<\/em>. Her <em>\u02bfiddah<\/em> will be <strong>valid<\/strong>.<a href=\"#_ftn4\" name=\"_ftnref4\">[4]<\/a><\/span><\/li>\n<\/ul>\n<p style=\"text-align: justify;\"><span style=\"color: #0000ff; font-family: 'book antiqua', palatino, serif;\"><strong><u>Scenario explaining this ruling:<\/u><\/strong><\/span><\/p>\n<ul style=\"text-align: justify;\">\n<li><span style=\"font-family: 'book antiqua', palatino, serif;\">A woman is 55 + years old and is considered to be in menopause.<\/span><\/li>\n<li><span style=\"font-family: 'book antiqua', palatino, serif;\">She is then divorced.<\/span><\/li>\n<li><span style=\"font-family: 'book antiqua', palatino, serif;\">So, her <em>\u02bfiddah<\/em> is counted as 3 lunar months or 90 days as mentioned previously.<\/span><\/li>\n<li><span style=\"font-family: 'book antiqua', palatino, serif;\">During these 3 lunar months of <em>\u02bfiddah<\/em>, she sees dark black\/red or another colour that was her habit for at least 3 days.<\/span><\/li>\n<\/ul>\n<p style=\"text-align: justify;\"><span style=\"color: #ff0000; font-family: 'book antiqua', palatino, serif;\"><strong>Solution:<\/strong><\/span><\/p>\n<ul style=\"text-align: justify;\">\n<li><span style=\"font-family: 'book antiqua', palatino, serif;\">This <em>\u02bfiddah<\/em> of counting as three lunar months becomes nullified.<\/span><\/li>\n<li><span style=\"font-family: 'book antiqua', palatino, serif;\">She would have to restart her <em>\u02bfiddah <\/em>by counting it as 3 <em>\u1e25ay\u1e0d<\/em> (i.e., she has to see 2 more <em>\u1e25ay\u1e0d<\/em> periods for her <em>\u02bfiddah<\/em> to be completed.)<\/span><\/li>\n<\/ul>\n<p style=\"text-align: justify;\"><span style=\"font-family: 'book antiqua', palatino, serif;\"><strong><u>Question<\/u><\/strong>: If after this <em>\u1e25ay\u1e0d<\/em> which broke her <em>\u02bfiddah<\/em> by lunar months, she does not see her <em>\u1e25ay\u1e0d <\/em>again, how would she continue and complete her <em>\u02bfiddah<\/em>?<\/span><\/p>\n<p style=\"text-align: justify;\"><span style=\"font-family: 'book antiqua', palatino, serif;\"><u><strong>Answer<\/strong>:<\/u><\/span><\/p>\n<ul style=\"text-align: justify;\">\n<li><span style=\"font-family: 'book antiqua', palatino, serif;\">Take medication to induce <em>\u1e25ay\u1e0d<\/em>. If this does not work, <strong>then:<\/strong><\/span><\/li>\n<li><span style=\"font-family: 'book antiqua', palatino, serif;\">Wait for 6 months in <em>\u02bfiddah<\/em>. If she sees no <em>\u1e25ay\u1e0d<\/em>, she is considered to be in menopause again after the 6 months. Then sit in <em>\u02bfiddah<\/em> for 3 more lunar months. Since counting \u02bf<em>iddah<\/em> by lunar months is not suspended on a judicial decree.<\/span><\/li>\n<\/ul>\n<p style=\"text-align: justify;\"><span style=\"font-family: 'book antiqua', palatino, serif; font-size: 10pt;\">\u00a0[<em>Raddul Mu\u1e25t\u0101r<\/em> 2\/308-309]<\/span><\/p>\n<ul style=\"text-align: justify;\">\n<li><span style=\"font-family: 'book antiqua', palatino, serif; font-size: 10pt;\">Z\u0101hid\u012b states: the decree of the <em>q\u0101\u1e0d\u012b<\/em> is not a condition for passing the ruling (that a woman is in menopause). This is the most apparent. So, when she reaches the period of menopause, she will pass <em>\u02bfiddah<\/em> by months and she is not in need of a judicial decree with regards to that. [<em>Z\u0101d-ul-Mutazawwij\u012bn<\/em>]<\/span><\/li>\n<\/ul>\n<p style=\"text-align: justify;\"><span style=\"font-family: 'book antiqua', palatino, serif; font-size: 10pt;\"><a href=\"#_ftnref2\" name=\"_ftn2\">[2]<\/a> <strong>Other Opinions<\/strong>:<\/span><\/p>\n<ul style=\"text-align: justify;\">\n<li><span style=\"font-family: 'book antiqua', palatino, serif; font-size: 10pt;\">Some scholars: If after 55, she sees blood it is not <em>\u1e25ay\u1e0d<\/em>.<em> \u1e62adr Shar\u012b\u02bfah<\/em> considers this as the <em>\u1e92\u0101hir<\/em> <em>Riw\u0101yah<\/em>. However, <strong>in \u201c<em>Mabs\u016b\u1e6d<\/em>\u201d, <em>Sarakhs\u012b, a greater \u1e24anaf\u012b <\/em>jurist<em>,<\/em> mentions that the <em>\u1e93\u0101hir<\/em> <em>riw\u0101yah<\/em> is that it is considered as <em>\u1e25ay\u1e0d<\/em> as mentioned in the rule above.<\/strong><\/span><\/li>\n<li><span style=\"font-family: 'book antiqua', palatino, serif; font-size: 10pt;\">If the judgement of her being in menopause is passed, then if she sees blood after 55, it is not <em>\u1e25ay\u1e0d<\/em>. Conversely, if the judgement is not passed of her being in menopause, then it is considered as <em>\u1e25ay\u1e0d<\/em>. (<strong>This is not the <em>\u1e63a\u1e25\u012b\u1e25<\/em><\/strong>)<\/span><\/li>\n<\/ul>\n<p style=\"text-align: justify;\"><span style=\"font-family: 'book antiqua', palatino, serif; font-size: 10pt;\"><a href=\"#_ftnref3\" name=\"_ftn3\">[3]<\/a> After mentioning that if after menopause began, the <em>\u1e25ay\u1e0d<\/em> returns, \u201c<em>Fat\u0101wa T\u0101rtarkh\u0101niyah\u201d<\/em> lists the following scenario:<\/span><\/p>\n<ul style=\"text-align: justify;\">\n<li><span style=\"font-family: 'book antiqua', palatino, serif; font-size: 10pt;\">\u201cIf the <em>q\u0101\u1e0d\u012b<\/em> had issued the verdict of the permissibility of that <em>nik\u0101\u1e25 <\/em>(which was contracted after she finished 3 lunar months of <em>\u02bfiddah<\/em>, after 55 years of age), then she saw blood, the judgement of the invalidity of the <em>nik\u0101\u1e25<\/em> would not be issued. The method of <em>qa\u1e0d\u0101\u2019<\/em> would be that one of the spouses claim that the <em>nik\u0101\u1e25<\/em> is invalid due to the \u02bf<em>iddah<\/em> stillstanding, so the <em>q\u0101\u1e0d\u012b <\/em>will pass a verdict that the <em>nikah<\/em> is valid and that the \u02bf<em>iddah<\/em> had ended already by the 3 months passing.\u201d [<em>Fat\u0101wa T\u0101rtarkh\u0101niyah <\/em>5\/229<em>]<\/em><\/span><\/li>\n<li><span style=\"font-family: 'book antiqua', palatino, serif; font-size: 10pt;\"><em>Hazrat<\/em> Th\u0101nv\u012b says, \u201cTo practise on this opinion there will be a need for a <em>q\u0101\u1e0d\u012b\u2019s<\/em> decree\u2026. In accordance with this <em>fatw\u0101<\/em>, the Muslim judge should give this woman the permission to pass her <em>\u02bfiddah<\/em> and contract a second <em>nikah<\/em>.\u201d [Imd\u0101dul Fat\u0101w\u0101 Jad<span style=\"font-family: 'book antiqua', palatino, serif;\">\u012b<\/span>d 5\/393]<\/span><\/li>\n<\/ul>\n<p style=\"text-align: justify;\"><span style=\"font-family: 'book antiqua', palatino, serif; font-size: 10pt;\"><a href=\"#_ftnref4\" name=\"_ftn4\">[4]<\/a> In \u201c<em>Hid\u0101yah\u201d<\/em>, it is mentioned that in the scenario where a woman sees <em>\u1e25ay\u1e0d <\/em>after completing her <em>\u02bfiddah<\/em> by counting it as 3 lunar months, her <em>\u02bfiddah<\/em> breaks and the <em>nik\u0101\u1e25<\/em> she performed also becomes invalid.<\/span><\/p>\n<p style=\"text-align: justify;\"><span style=\"font-family: 'book antiqua', palatino, serif; font-size: 10pt;\">However, the opinion mentioned in \u201c<em>Mujtab\u0101\u201d<\/em> as stated above (it does not break the <em>\u02bfiddah<\/em> nor make the <em>nik\u0101\u1e25<\/em> invalid) is<strong> more correct<\/strong> than that which is mentioned in \u201c<em>Hid\u0101yah\u201d<\/em><\/span><\/p>\n<p style=\"text-align: justify;\">\n","protected":false},"excerpt":{"rendered":"<p>\u1e24ay\u1e0d terminates when a woman reaches the age of menopause.<br \/>\nAge of \u201closing hope\u201d for \u1e24ay\u1e0d and Nif\u0101s (i.e., Menopausal Age)<\/p>\n<p>Lunar: 55 years.
