Through the infinite grace and assistance from All\u0101h Ta\u02bf\u0101l\u0101<\/em><\/span> alone, He\u00a0 has granted us the tawf\u012bq<\/em> to begin this task of sharing important information and mas\u0101\u2019il<\/em> regarding menses (\u1e24ay\u1e0d<\/em>), dysfunctional uterine bleeding (Isti\u1e25\u0101\u1e0dah<\/em>) and lochia (Nif\u0101s<\/em>) mainly sourced from \u201cManhal al W\u0101rid\u012bn\u201d<\/em>, \u02bfAll\u0101mah Ibn \u02bf\u0100bid\u012bn al-Sh\u0101m\u012b\u2019s \u0631\u062d\u0645\u0647 \u0627\u0644\u0644\u0647<\/span> commentary on Im\u0101m Birgiv\u012b\u2019s \u0631\u062d\u0645\u0647 \u0627\u0644\u0644\u0647 \u201cDhukhrul Muta\u2019h-hil\u012bn\u201d<\/em>.<\/span><\/p>\n

The Importance of Studying The Fiqh of \u1e24ay\u1e0d In Depth<\/strong><\/span><\/p>\n

Im\u0101m Birgiv\u012b \u0631\u062d\u0645\u0647 \u0627\u0644\u0644\u0647 mentions in \u201cDhukhrul Muta\u2019h-hil\u012bn\u201d<\/em>:<\/span><\/p>\n

\u201c<\/em>The fuqah\u0101\u2019 agree that seeking knowledge of \u02bfilm \u1e25\u0101l [the knowledge of what is necessary and binding upon one at the present moment] is far\u1e0d <\/em>upon everyone who believes in All\u0101h and the last day; both women and men. The knowledge of the [rulings] of blood specific to women, is obligatory upon her and her husband and guardians but this [knowledge of the bloods specific to women] has become \u201cdust, dispersing\u201d (S\u016brah Al-W\u0101qi\u02bfah: 6); it has become abandoned in our time. Rather, it has become something that is not even mentioned. The people of our time [i.e., the author, Brigiv\u012b\u2019s era and he passed away in 981 A.H] do not differentiate between menstruation, post-natal bleeding, and dysfunctional uterine bleeding [in many mas\u0101\u2019il], nor do they differentiate between valid and invalid bloods and purities. You will see [i.e, know that] the best of them [i.e, most knowledgeable according to himself] suffices on the famous (fiqh) texts [like Qud\u016br\u012b, Kanz al-Daq\u0101\u2019iq, al-Wiq\u0101yah, and al-Mukht\u0101r which are all concise], and many mas\u0101\u2019il of [these three bloods] are not mentioned in them.\u201d<\/em><\/span><\/strong><\/p>\n

This statement of Im\u0101m Birgiv\u012b \u0631\u062d\u0645\u0647 \u0627\u0644\u0644\u0647, highlights the importance of studying the fiqh<\/em> of \u1e25ay\u1e0d<\/em> due to the following three reasons:<\/span><\/p>\n

  1. It is knowledge which is obligatory to seek just like it is obligatory for a person who accepted Isl\u0101m<\/em> in the morning to learn and understand the meaning of the Kalimah Shah\u0101dah<\/em> and then if he lives until \u1e92uhr<\/em>, it is obligatory for him to learn the rulings of purity and \u1e63al\u0101h<\/em>. [Fat\u0101w\u0101 T\u0101tarkh\u0101niyyah<\/em>]<\/span><\/li>\n
  2. Although it is obligatory to seek this branch of fiqh<\/em>, its study has been abandoned.<\/span><\/li>\n
  3. Even if it is studied, it is not studied in depth.<\/span><\/li>\n<\/ol>\n

    Other reasons of its importance are as follows:<\/span><\/p>\n

    • \u201cThe validity of many other rulings is based on this such as: \u1e63a<\/em>l\u0101h<\/em>, fasting, reading and touching the Qur\u2019\u0101n<\/em>, i\u02bftik\u0101f<\/em>, entering the Masjid<\/em>, \u1e6daw\u0101f<\/em> of \u1e24ajj<\/em>, puberty, divorce, \u02bfiddah<\/em>, permissibility of intercourse, lineage.\u201d [\u02bfAll\u0101mah Shuranbal\u0101l\u012b \u0631\u062d\u0645\u0647 \u0627\u0644\u0644\u0647]<\/span><\/li>\n
    • \u201cIt is one of the most important aspects of fiqh<\/em> because the significance of knowledge is understood by the harm which is caused due to ignorance of that branch of knowledge. Ignorance with regards to the rulings of \u1e25ay\u1e0d<\/em> causes greater harm than ignorance in any other ruling.\u201d [Manhal al W\u0101rid\u012bn pg. <\/em>108] This is so as ignorance and incorrect understanding of these rulings will lead one to leave something that is obligatory or commit something that is forbidden.<\/span><\/li>\n<\/ul>\n

      • It is considered as one of the most detailed, difficult, precise and intricate topics in the study of fiqh<\/em>.<\/span><\/li>\n
      • Im\u0101m Birgiv\u012b \u0631\u062d\u0645\u0647 \u0627\u0644\u0644\u0647 mentions in \u201cDhukhrul Muta\u2019h-hil\u012bn\u201d<\/em>: \u201cThere are three aspects found in the mas\u0101\u2019il<\/em> of \u1e25ay\u1e0d<\/em>:<\/span><\/li>\n<\/ul>\n

        1. Abundance.<\/span><\/li>\n
        2. Difficulty.<\/span><\/li>\n
        3. Ikhtil\u0101f\u0101t<\/em> (differences of opinion).<\/span><\/li>\n<\/ol>\n

          • Due to this, the dedication and effort required to grasp these concepts and master this subject are usually lacking.<\/span><\/li>\n
          • However, as it has become apparent by the points mentioned above, the study of this aspect of fiqh<\/em> in details is very important, specifically for the scholars as they are responsible for answering the queries of the public.<\/span><\/li>\n
          • As Mawl\u0101n\u0101<\/em> Ashraf \u02bfAl\u012b Thanvi \u0631\u062d\u0645\u0647 \u0627\u0644\u0644\u0647 states: \u201cHer problem is a very intricate one and difficult to understand. Therefore, ask a big \u0100lim regarding it and never ask a regular Molvi about it<\/em>.\u201d [Bahishti Zewar<\/em> (Urdu) 2\/274]<\/span><\/li>\n
          • This shows that although knowing the basics is essential for the ordinary person, knowing the details is essential for the \u0100lim<\/em>. Thus, it is necessary for the \u0100lim<\/em> to dedicate himself to studying it in depth and grasp its concepts so that he\/she develops the ability to apply their rulings to solve the intricate cases.<\/span><\/li>\n<\/ul>\n
