{"id":6668,"date":"2018-12-11T00:24:20","date_gmt":"2018-12-11T04:24:20","guid":{"rendered":"https:\/\/www.fiqhulislam.com\/?p=6668"},"modified":"2018-12-11T00:24:20","modified_gmt":"2018-12-11T04:24:20","slug":"saying-salam-to-the-opposite-gender","status":"publish","type":"post","link":"https:\/\/www.fiqhulislam.com\/?p=6668","title":{"rendered":"Saying Salam to the Opposite Gender"},"content":{"rendered":"<p style=\"text-align: center;\"><span style=\"color: #000000;\">\u0628\u0633\u0645 \u0627\u0644\u0644\u0647 \u0627\u0644\u0631\u062d\u0645\u0646 \u0627\u0644\u0631\u062d\u064a\u0645<\/span><\/p>\n<p><span style=\"color: #000000;\">Abu Huraira \u0631\u0636\u064a \u0627\u0644\u0644\u0647 \u0639\u0646\u0647 narrates that the Messenger of Allah (\ufdfa) said, &#8220;A believer owes another believer five rights.&#8221; The first right mentioned was &#8216;responding to salam.&#8217;<a style=\"color: #000000;\" href=\"#_ftn1\" name=\"_ftnref1\">[1]<\/a><\/span><\/p>\n<p><span style=\"color: #000000;\">The scholars state that it is compulsory to reply to salam. However, certain cases are exempted from this obligation due other <em>nusoos<\/em> (textual evidences) of Shariah.<\/span><\/p>\n<p><span style=\"color: #000000;\">On the issue of a woman saying <em>salam<\/em> or replying to a man and vice versa, the <em>muhaddith<\/em> and <em>faqeeh<\/em>, Mulla Ali Qari quotes Imam Nawawi as saying:<\/span><\/p>\n<p><span style=\"color: #000000;\"> \u201cAs for [the case of] a woman with a man, so if she is his wife, his slave girl or a <em>mahram<\/em> to him then she is like a man to him [in ruling].<\/span><\/p>\n<p><span style=\"color: #000000;\">But if she is a stranger [non-<em>mahram<\/em>] to him, [then it is either of two cases,] if she is beautiful [or young]<a style=\"color: #000000;\" href=\"#_ftn2\" name=\"_ftnref2\">[2]<\/a> with whom <em>fitna<\/em> is feared, then the man would not say <em>salam<\/em> to her, but if he does say <em>salam<\/em>, it is not permissible for her to reply. <\/span><\/p>\n<p><span style=\"color: #000000;\">A woman should not say <em>salam<\/em> to a strange man. But if she says <em>salam<\/em> to him, she does not deserve a reply. If he replies to her <em>salam<\/em> he would have done something reprehensible.<\/span><\/p>\n<p><span style=\"color: #000000;\">[The second case is] if she is an old woman with whom<em> fitna<\/em> is not feared,<a style=\"color: #000000;\" href=\"#_ftn3\" name=\"_ftnref3\">[3]<\/a> it is permissible for her to say <em>salam<\/em> to a man and it would be necessary on him to reply to the <em>salam<\/em>.\u201d<a style=\"color: #000000;\" href=\"#_ftn4\" name=\"_ftnref4\">[4]<\/a><\/span><\/p>\n<p><span style=\"color: #000000;\">Since this is the law regarding <em>salam<\/em> and its reply, which is a right of a Muslim in normal circumstances what would be the ruling of the unnecessary everyday conversations with non-<em>mahram<\/em> men and women in work places, schools, universities and other social gatherings?<\/span><\/p>\n<p><span style=\"color: #000000;\">And Allah knows best.<\/span><\/p>\n<hr \/>\n<p><span style=\"color: #000000;\"><a style=\"color: #000000;\" href=\"#_ftnref1\" name=\"_ftn1\">[1]<\/a> Bukhari #1240, Muslim #1704<\/span><\/p>\n<p><span style=\"color: #000000;\"><a style=\"color: #000000;\" href=\"#_ftnref2\" name=\"_ftn2\">[2]<\/a> Imam Nawawi used the word \u0634\u0627\u0628\u0629 \u2018young girl\u2019 in Sharh Saheeh Muslim Vol.14 Pg.149<\/span><\/p>\n<p><span style=\"color: #000000;\"><a style=\"color: #000000;\" href=\"#_ftnref3\" name=\"_ftn3\">[3]<\/a> In Sharh Saheeh Muslim, Imam Nawawi says that if the old woman is attractive , then salam should not be said to her nor the reply given.
