A woman was pregnant and in this condition her husband gave her the <em>talaq mughallazah<\/em> (3 divorces). Upon the termination of her <em>eddah<\/em> by childbirth, she married another man. Unfortunately, the second husband also divorced her. After delivery this woman did not menstruate for a year or year and a half. This issue affects many women. Now what is the method of completing her <em>eddah<\/em>? Can this woman count her <em>eddah<\/em> by months?<\/p>\n<p style=\"text-align: justify;\"><span style=\"color: #0000ff;\">Answer:<\/span><\/p>\n<p style=\"text-align: justify;\">In the case under discussion, it is necessary to count her <em>eddah<\/em> by menstrual periods according to the <em>Hanafiyah<\/em>. It is mentioned in \u2018Durr Mukhtaar\u2019:<\/p>\n<p style=\"text-align: justify;\">\u0648\u062e\u0631\u062c \u0628\u0642\u0648\u0644\u0647 ( \u0648\u0644\u0645 \u062a\u062d\u0636 ) \u0627\u0644\u0634\u0627\u0628\u0629 \u0627\u0644\u0645\u0645\u062a\u062f\u0629 \u0628\u0627\u0644\u0637\u0647\u0631 \u0628\u0623\u0646 \u062d\u0627\u0636\u062a \u062b\u0645 \u0627\u0645\u062a\u062f \u0637\u0647\u0631\u0647\u0627 \u0641\u062a\u0639\u062a\u062f \u0628\u0627\u0644\u062d\u064a\u0636 \u0625\u0644\u0649 \u0623\u0646 \u062a\u0628\u0644\u063a \u0633\u0646 \u0627\u0644\u0623\u064a\u0627\u0633 \u00a0\u062c\u0648\u0647\u0631\u0629 \u0648\u063a\u064a\u0631\u0647\u0627 (\u062f\u0631 \u0645\u062e\u062a\u0627\u0631 \u0645\u0639 \u0627\u0644\u0634\u0627\u0645\u064a \u062c 2 \u0635 828 \u0628\u0627\u0628 \u0627\u0644\u0639\u062f\u0629)<\/p>\n<p style=\"text-align: justify;\">If waiting this long in <em>eddah<\/em> is unbearable, then she should take medication to induce her periods. If she is unsuccessful and there is a strong danger of falling into sin, then she should take a fatwa of counting the <em>eddah<\/em> by months (9 months or one year) from a Maliki Mufti or get a verdict from a <em>Shar\u2019ee<\/em> council and then practice accordingly. (That\u2019s all.)<\/p>\n<p style=\"text-align: justify;\"><span style=\"color: #0000ff;\">The Fatwa of Hakeemul Ummat Maulana Ashraf Ali Thanvi \u0646\u0648\u0631 \u0627\u0644\u0644\u0647 \u0645\u0631\u0642\u062f\u0647:<\/span><\/p>\n<p style=\"text-align: justify;\"><span style=\"color: #0000ff;\">Answer:<\/span><\/p>\n<p style=\"text-align: justify;\">From the chapter of <em>Eddah<\/em> in <em>Durr Mukhtaar<\/em> and <em>Raddul Muhtaar<\/em>, it is clear that in such a condition she must wait on her periods until menopause, according to the Hanafiyah. According to the Malikiyah, the <em>edaah<\/em> would be nine months or based on the relied upon opinion one year. It is permissible to act on this opinion at the time of need. End quote.<\/p>\n<p style=\"text-align: justify;\">This humble one [Hazrat Thanvi] says that one should take the following into consideration:<\/p>\n<p style=\"text-align: justify;\">Firstly, remedy it. [Induce the periods. Translator&#8217;s note] Secondly, there will be a need for a <em>Qadhi\u2019s<\/em>\u00a0(Muslim judge&#8217;s) verdict to practice on this opinion. A Muslim Judge, even if appointed by a Non-Muslim king is a <em>Shar\u2019ee Qadhi<\/em>. Therefore, she should put a request that a Muslim judge be given the authority to issue a verdict with regards to this matter. Then this Muslim judge should grant her the permission to marry again after completing her <em>eddah<\/em> in accordance to this fatwa. This is what should be done. Thirdly, if she started to count her <em>eddah<\/em> based on this opinion but then she saw a menstrual period before the year ends, then the <em>eddah<\/em> would have to be counted by the menstrual periods. And Allah knows best. 9<sup>th<\/sup> Dhil Qa\u2019dah 1325 AH. <span style=\"color: #0000ff;\">(Imdaadul Fatawa Vol.2 Pg.431-432)<\/span><\/p>\n<p style=\"text-align: justify;\"><span style=\"color: #0000ff;\">The Fatwa of the Grand Mufti Hazrat Maulana Mufti Kifayatullah \u0642\u062f\u0633 \u0633\u0631\u0647:<\/span><\/p>\n<p style=\"text-align: justify;\">This woman is one who has long spells of purity (\u0645\u0645\u062a\u062f\u0629 \u0627\u0644\u0637\u0647\u0631). According to the <em>Hanafiyah<\/em>, her <em>eddah <\/em>will only be completed by menstrual periods unless she reaches the age of menopause. However, according to Imam Malik the verdict of the termination of her <em>eddah<\/em> is issued in the case where she does not see a menstrual period for nine months according to one narration and one year according to another. So if there is any severe need and there is a strong danger of falling into haram or any such vice by not marriying a second time, then take a fatwa from a Maliki and practice on it.
