Someone suggested that we can mark the graves based on rows and section. Others said numbers. One person highlighted the narration that the Prophet \u0635\u0644\u0649 \u0627\u0644\u0644\u0647 \u0639\u0644\u064a\u0647 \u0648\u0633\u0644\u0645 placed a head stone by the grave of one of his companions with the reason being to know his exact position so as to visit him and make <em>dua<\/em>. We trying to get a system of being able to identify the graves. We thinking about doing a spread sheet with codes sticked up on a notice board like number of rows and grave number etc. A map system. Is this permissible? Can you please clarify this for me? Jazaakumullaahu khairaa. Trinidad.<\/p>\n<p style=\"text-align: justify;\"><span style=\"color: #000080;\"><strong>Answer:<\/strong> \u062d\u0627\u0645\u062f\u0627 \u0648\u0645\u0635\u0644\u064a\u0627 \u0648\u0645\u0633\u0644\u0645\u0627<\/span><\/p>\n<p style=\"text-align: justify;\">Our belief is that the grave is a temporary abode for the departed, not one of eternity. Therefore immortalizing the deceased by inscribing his name on an embedded stone at the head of the grave goes against the spirit of <em>Shariah<\/em>.<a href=\"#_edn1\" name=\"_ednref1\">[1]<\/a><\/p>\n<p style=\"text-align: justify;\">There are two hadiths which are generally quoted on this issue.<\/p>\n<ol style=\"text-align: justify;\">\n<li>Jabir (\u0631\u0636\u064a \u0627\u0644\u0644\u0647 \u0639\u0646\u0647) narrates that the Messenger of Allah (\u0635\u0644\u0649 \u0627\u0644\u0644\u0647 \u0639\u0644\u064a\u0647 \u0648\u0633\u0644\u0645) <strong>prohibited<\/strong> plastering graves, <strong>writing on them<\/strong>, building over them, and treading on them.<a href=\"#_edn2\" name=\"_ednref2\">[2]<\/a><\/li>\n<li>In a narration of Abu Dawud it is mentioned that the Messenger of Allah (\u0635\u0644\u0649 \u0627\u0644\u0644\u0647 \u0639\u0644\u064a\u0647 \u0648\u0633\u0644\u0645) placed a rock by the head of Uthman ibn Madh\u2019un\u2019s (\u0631\u0636\u064a \u0627\u0644\u0644\u0647 \u0639\u0646\u0647) grave and said, \u201cI am marking the grave of my brother with it and I shall bury here whoever dies of my family.\u201d<a href=\"#_edn3\" name=\"_ednref3\">[3]<\/a><\/li>\n<\/ol>\n<p style=\"text-align: justify;\">In the second hadith, there were two reasons mentioned for placing the rock. One is to recognize the grave and second is to be able to bury other family members there. Based on this, some scholars grant a leeway in writing <strong>only<\/strong> the names of the deceased on headstones<a href=\"#_edn4\" name=\"_ednref4\">[4]<\/a> beside such graves where people may not realize that one is present there and may end up trampling, sitting or disrespecting it in any other way.<a href=\"#_edn5\" name=\"_ednref5\">[5]<\/a> They state that writing is also a means of identifying a grave.<a href=\"#_edn6\" name=\"_ednref6\">[6]<\/a> Another place they granted this permission is when the deceased was a righteous role model whom others would like to visit from far and wide.<a href=\"#_edn7\" name=\"_ednref7\">[7]<\/a> As the years passed and the <em>Ummah<\/em> grew, simply placing a rock was no longer sufficient in identifying a buried family member. So allowance was also granted for the purpose of identification.<a href=\"#_edn8\" name=\"_ednref8\">[8]<\/a> Yet they state that in general, <strong>abstinence from writing will be better<\/strong>. Hazrat Mufti Saeed Palunpuri (\u062d\u0641\u0638\u0647 \u0627\u0644\u0644\u0647), the <em>Shaikhul Hadith<\/em> of Darul Uloom Deoband strongly advocates against writing names on grave heads. He says the authentic hadith of Jabir (\u0631\u0636\u064a \u0627\u0644\u0644\u0647 \u0639\u0646\u0647) collected by Imam Tirmithi (\u0631\u062d\u0645\u0647 \u0627\u0644\u0644\u0647) clearly prohibits this. People start with writing the name, then the date of death is added, thereafter some add poems, others write eulogies full of flattery and some even inscribe verses of the Quran Majid. He comments that the permissibility of these can never be deduced from <em>ta\u2019aamul<\/em> (the actions of the masses), especially since the Messenger (\u0635\u0644\u0649 \u0627\u0644\u0644\u0647 \u0639\u0644\u064a\u0647 \u0648\u0633\u0644\u0645) expressly prohibited writing on graves. The Hanafi <em>fuqaha<\/em> have categorically prohibited writing these things (poems, eulogies and Quranic verses) on a grave stone.<a href=\"#_edn9\" name=\"_ednref9\">[9]<\/a> Mufti sahib also said, who is a worthy person? What is the criterion of pointing out who should have a headstone due to his piety and who should not? Everyone would consider their relative worthy of one. He further explains that an evil side-effect of this is that the grave then is reserved for the person whose name is inscribed on the stone. Therefore instead of reusing graves after the bones have decomposed, the community has to buy another plot of land for burial. In this manner the older graveyards become obsolete and people squat on them, graze their livestock in them and do other prohibited and disrespectful acts.<a href=\"#_edn10\" name=\"_ednref10\">[10]<\/a> Community grave yards are <em>waqf<\/em> endowments and can only be used for the purpose of burial.<a href=\"#_edn11\" name=\"_ednref11\">[11]<\/a><\/p>\n<blockquote>\n<p style=\"text-align: justify;\">In summary, graves should not be over-revered nor should they be degraded. Over-reverence is plastering them, building on them and placing headstones with the above mentioned inscriptions, etc. This is why these were prohibited in the hadith. Conversely, degrading them by walking or sitting on them and defecating near them, etc. is also prohibited in the hadith.<a href=\"#_edn12\" name=\"_ednref12\">[12]<\/a><\/p>\n<\/blockquote>\n<p style=\"text-align: justify;\">Due to the above mentioned reasons, it would therefore be best to take the opinion of those scholars who prohibit writing on gravestones.<a href=\"#_edn13\" name=\"_ednref13\">[13]<\/a><\/p>\n<p style=\"text-align: justify;\">Nevertheless, identifying a grave is a requirement for those who want to visit and bury other family members there.<a href=\"#_edn14\" name=\"_ednref14\">[14]<\/a> This is why the vast majority of Fuqahaa (Jurists) have granted permission to use items similar to a rock [as mentioned in the hadith] to mark graves.<a href=\"#_edn15\" name=\"_ednref15\">[15]<\/a> So there should be an allowance in using such a method which can fulfil this need and yet stay away from all the ills attached to headstones, which Mufti sahib elaborated on.<\/p>\n<p style=\"text-align: justify;\">Therefore, there will be an allowance in mapping out the graves on a chart and listing the names of the people buried in each plot (as the graves should be reused)<a href=\"#_edn16\" name=\"_ednref16\">[16]<\/a>. This may then be posted on a notice board at the entrance of the graveyard.<a href=\"#_edn17\" name=\"_ednref17\">[17]<\/a> With modern technology an electronic digital board may also be used which could easily store much more information on a hard disk within the least space possible.<\/p>\n<p style=\"text-align: justify;\"><span style=\"color: #000080;\">And Allah Ta\u2019ala knows best.<\/span><\/p>\n<p style=\"text-align: justify;\">Muhammad ibn Suleman Chothia<\/p>\n<p style=\"text-align: justify;\">Reviewed and Endorsed by Mufti Muhammad Mahdi<\/p>\n<p style=\"text-align: justify;\">10th Sha\u2019ban, 1437\/17th May, 2016\/ FID#2016111<\/p>\n<hr \/>\n<p style=\"text-align: justify;\"><a href=\"#_ednref1\" name=\"_edn1\">[1]<\/a> Mufti Salman Mansurpuri in Kitabun Nawaazil Vol.6 Pg.233<\/p>\n<p style=\"text-align: justify;\"><a href=\"#_ednref2\" name=\"_edn2\">[2]<\/a> Tirmithi #1052. He classified it as sound and authentic.<\/p>\n<p style=\"text-align: justify;\"><a href=\"#_ednref3\" name=\"_edn3\">[3]<\/a> Abu Dawud #3206. Graded as sound by Ibn Mulaqqin in \u2018Badrul Muneer\u2019 Vol.5 Pg.325, Ibn Hajr in \u2018Tallkhisul Habir\u2019 Vol.3 Pg.1241 and Zafar Usmani in \u2018E\u2019laus Sunan\u2019 Vol.8 Pg.320. Uthman ibn Madh\u2019un (\u0631\u0636\u064a \u0627\u0644\u0644\u0647 \u0639\u0646\u0647) was the foster brother of the Messenger of Allah (\u0635\u0644\u0649 \u0627\u0644\u0644\u0647 \u0639\u0644\u064a\u0647 \u0648\u0633\u0644\u0645). [See Mirqaatul Mafaatih\u00a0 Vol. 4 Pg.168]<\/p>\n<p style=\"text-align: justify;\"><a href=\"#_ednref4\" name=\"_edn4\">[4]<\/a> This is <strong>not<\/strong> analogy versus the hadith of Jabir which prohibits writing (\u0642\u064a\u0627\u0633 \u0641\u064a \u0645\u0642\u0627\u0628\u0644\u0629 \u0627\u0644\u0646\u0635), rather it is making exemptions from the prohibition through analogy on the hadith of Uthman which has granted some permissions (\u0627\u0644\u062a\u062e\u0635\u064a\u0635 \u0628\u0627\u0644\u0642\u064a\u0627\u0633). The Messenger of Allah said, \u201cIf one of you were to sit on a live coal and have it burn his clothes until it reached his skin, that would be better for him than sitting on a grave.\u201d [Muslim #971] It was narrated from &#8216;Uqbah bin &#8216;Amir that the Messenger of Allah said, \u201cIf I were to walk on a live coal or a sword, or if I were to sew my shoes to my feet, that would be better for me than walking on the grave of a Muslim. The <em>muhaddithun<\/em> from Bukhari to Ibn Asaakir, Khatib Bhagdadi to Zahabi and from Ibn Kathir to Ibn Hajr Asqalani all wrote biographies of scholars and mentioned where and when they died. On many occasions they named the graveyards in which these people were buried and even the person they were laid down next to.
