Some people do it after the first salaam and others do it after the second salaam. Which is correct?<\/p>\n<p style=\"text-align: justify;\"><span style=\"color: #0000ff;\"><strong>Answer:\u00a0<\/strong><strong>\u062d\u0627\u0645\u062f\u0627 \u0648\u0645\u0635\u0644\u064a\u0627 \u0648\u0645\u0633\u0644\u0645\u0627 <\/strong><\/span><\/p>\n<p style=\"text-align: justify;\">There seems to be some confusion on this issue for quite some time. Therefore a detailed answer will be needed to clarify the issue with the help of Allah Ta\u2019ala.<\/p>\n<p style=\"text-align: justify;\">First and foremost, the vast majority of scholars agree that the last sitting (<em>qa\u2019dah akhirah<\/em>) in Salah is compulsory. They differ concerning the amount that is compulsory.<a href=\"#_edn1\" name=\"_ednref1\">[1]<\/a> The Hanafi scholars state that it is <em>Fardh<\/em> to sit in the last <em>qa\u2019dah<\/em> for the duration of time it takes to recite the <em>tashahhud<\/em>.<a href=\"#_edn2\" name=\"_ednref2\">[2]<\/a> This is established in the following hadith.<\/p>\n<p style=\"text-align: justify;\">Abdullah ibn Mas&#8217;ud (\u0631\u0636\u064a \u0627\u0644\u0644\u0647 \u0639\u0646\u0647) said that the Messenger of Allah (\ufdfa) caught hold of his hand and taught him the <em>tashahhud<\/em> of Salah. He then narrated the well-known <em>dua<\/em> of <em>tashahhud<\/em>. The end of the hadith states, \u201cWhen you say this (the <em>tashahhud<\/em>), or complete (sitting the duration of) it, then you have finished your prayer. If you wish to stand up you may do so and if you wish to sit, you may do so.\u201d<a href=\"#_edn3\" name=\"_ednref3\">[3]<\/a><\/p>\n<p style=\"text-align: justify;\">They also state that the \u2018<em>salaah -was-salaam<\/em>\u2019 (<em>darood<\/em>), <em>dua<\/em> and <em>salaam<\/em> are not <em>Fardh<\/em> in Salah, since there is the option of standing up in this hadith. They explain that the first two (<em>darood <\/em>and <em>dua<\/em>) are <em>Sunnah Muakkadah<\/em><a href=\"#_edn4\" name=\"_ednref4\">[4]<\/a> while <em>salaam<\/em> is <em>Waajib<\/em>.<a href=\"#_edn5\" name=\"_ednref5\">[5]<\/a> The Messenger of Allah (\ufdfa) said, \u201cThe key to prayer is purification, and its sacredness (begins) with the <em>Takbir<\/em>, and its <strong>release is the <em>Taslim<\/em> (saying <em>salaam<\/em>)<\/strong>.&#8221;<a href=\"#_edn6\" name=\"_ednref6\">[6]<\/a><\/p>\n<p style=\"text-align: justify;\">Based on this, the following laws are deduced:<\/p>\n<ol>\n<li style=\"text-align: justify;\">If a <em>masbooq<\/em> (one who has missed a <em>rak\u2019ah<\/em> or more) gets up after he recites the <em>tashahhud <\/em>(or sitting the duration of its recital), then his Salah will still remain <strong>valid<\/strong> as all the <em>faraaidh<\/em> has been completed. However, this will be <strong>impermissible<\/strong> and <strong><em>makrooh tahrimi<a href=\"#_edn7\" name=\"_ednref7\"><strong>[7]<\/strong><\/a><\/em><\/strong> since the Messenger (\ufdfa) commanded us to follow the Imam in many <em>ahadith<\/em>. For instance he said, \u201cThe Imam was appointed to be followed, so do not differ from him.\u201d<a href=\"#_edn8\" name=\"_ednref8\">[8]<\/a> He also expressly prohibited from exiting the Salah before the Imam in the following hadith. Anas (\u0631\u0636\u064a \u0627\u0644\u0644\u0647 \u0639\u0646\u0647) reported that the Messenger of Allah (\ufdfa) one day led us in the Salah and when he completed the Salah he turned his face towards us and said, \u201cO People, I am your Imam, so do not precede me in bowing and prostration and in standing and <strong>turning (faces on pronouncing <em>salaam<\/em>)<\/strong>, for I see you in front of me and behind me.\u201d<a href=\"#_edn9\" name=\"_ednref9\">[9]<\/a> Therefore, it is <em>waajib <\/em>to follow the Imam till the <em>salaam <\/em>and <em>makrooh tahrimi<\/em> to get up before it.<a href=\"#_edn10\" name=\"_ednref10\">[10]<\/a><\/li>\n<\/ol>\n<p style=\"text-align: justify;\">N.B. All the Hanafi scholars agree that a <em>makrooh tahrimi<\/em> act is prohibited in <em>Shariah<\/em> in a mandatory manner. It is compulsory to refrain from a <em>makrooh tahrimi<\/em> act and it is a sin to commit it. <a href=\"#_edn11\" name=\"_ednref11\">[11]<\/a>\u00a0 Rather, Imam Muhammad, a formulator of the Hanafi school of thought, is of the opinion that both, <em>haraam<\/em> and <em>makrooh tahrimi<\/em>, are similar in the level of prohibition and the severity of punishment.<a href=\"#_edn12\" name=\"_ednref12\">[12]<\/a><\/p>\n<ol style=\"text-align: justify;\" start=\"2\">\n<li>If the <em>masbooq<\/em> gets up after the first <em>salaam <\/em>when the Imam begins saying the second<em> salaam<\/em>, his Salah will still be valid. <a href=\"#_edn13\" name=\"_ednref13\">[13]<\/a> However, standing before the completion of the second <em>salaam<\/em> would be <em>khilaaful awlaa (not the best option)<\/em> unless his standing was due to a valid reason, like the fear of someone passing in front of him.<a href=\"#_edn14\" name=\"_ednref14\">[14]<\/a> The reason behind this not being the best option is mentioned below.<\/li>\n<li>The Hanafi <em>fuqaha<\/em> have clearly stated that the <em>masbooq<\/em> should stand up after <strong>both <\/strong><em>salaams<\/em> when it becomes evident that the Imam will not perform <em>sajda &#8211; sahw<\/em>.<a href=\"#_edn15\" name=\"_ednref15\">[15]<\/a> So the first reason for this delay is to ensure there is no <em>sajda \u2013 sahw<\/em> on the Imam.<\/li>\n<\/ol>\n<p style=\"text-align: justify;\">Al-Mughirah bin Shu&#8217;bah (\u0631\u0636\u064a \u0627\u0644\u0644\u0647 \u0639\u0646\u0647) narrated, &#8220;We reached the people while they had already stood in Salah. Abdur-Rahman bin &#8216;Awf (\u0631\u0636\u064a \u0627\u0644\u0644\u0647 \u0639\u0646\u0647) was leading them and he had already completed a <em>rakah <\/em>with them. When he realised that the Prophet (\ufdfa) was there, he started to retreat, but the Prophet (\ufdfa) motioned to him to continue. So he led them in Salah. [So the Prophet (\ufdfa) and I prayed one <em>rak&#8217;ah<\/em> behind him.] <strong>After he made <em>salaam<\/em>, the Prophet <\/strong>(\ufdfa)<strong> stood up<\/strong> and I stood up and we completed the <em>rak&#8217;ah<\/em> that we had missed.&#8221;<a href=\"#_edn16\" name=\"_ednref16\">[16]<\/a><\/p>\n<p style=\"text-align: justify;\">From the above it is quite clear that one should stand after both salaams, however due to a valid reason one may stand before completion of both salaams.<\/p>\n<p style=\"text-align: justify;\">Some Hanabilah<a href=\"#_edn17\" name=\"_ednref17\">[17]<\/a> scholars were of the view that if the <em>masbooq <\/em>stands before the second salaam, his <em>Fardh<\/em> Salah would become <em>nafl. <\/em>Others even said, it will become completely null and void.<a href=\"#_edn18\" name=\"_ednref18\">[18]<\/a> All the scholars agree that it is desirable to practice the <em>Deen<\/em> in such a manner that our <em>ebadah<\/em> etc. is valid according to all the reputable scholars wherever possible.<a href=\"#_edn19\" name=\"_ednref19\">[19]<\/a> Therefore, this is another reason to delay getting up until after both salaams.<\/p>\n<p style=\"text-align: justify;\"><span style=\"color: #0000ff;\">And Allah Ta&#8217;ala knows best.<\/span><\/p>\n<p style=\"text-align: justify;\">May Allah Azza wa Jall grant us the ability to perform our five times daily Salah behind an Imam from the very first <em>takbeer<\/em>. Yaa Rabbal \u2018Aalameen.<\/p>\n<p style=\"text-align: justify;\">Muhammad ibn Suleman Chothia in collaboration with Mufti Muhammad Mahdi<\/p>\n<p style=\"text-align: justify;\">12th Rajab, 1437\/18th April, 2016\/ FID#2016109<\/p>\n<p style=\"text-align: justify;\"><span style=\"color: #0000ff;\"><strong><u>Below are translations of some <em>fatawa<\/em> on this issue with further clarification:<\/u><\/strong><\/span><\/p>\n<ol style=\"text-align: justify;\">\n<li>The late grand Mufti of Deoband, Mufti Azizur Rahman (\u0631\u062d\u0645\u0647 \u0627\u0644\u0644\u0647):<\/li>\n<\/ol>\n<p style=\"text-align: justify;\"><strong>Question:<\/strong><\/p>\n<p style=\"text-align: justify;\">Will the <em>masbooq<\/em> stand to complete his remaining <em>rakats<\/em> after the Imam\u2019s first <em>salaam<\/em> or second one?<\/p>\n<p style=\"text-align: justify;\"><strong>Answer:<\/strong><\/p>\n<p style=\"text-align: justify;\">It is better to stand <strong>after both <em>salaams<\/em><\/strong> are made so that if there is a <em>sajdah-sahw<\/em> on the Imam, he will not have to come back down.<\/p>\n<p style=\"text-align: justify;\">[<strong>Fatawa Darul Uloom Qadeem<\/strong>]<a href=\"#_edn20\" name=\"_ednref20\">[20]<\/a><\/p>\n<ol style=\"text-align: justify;\" start=\"2\">\n<li>The late grand Mufti of India, Faqeehul Ummat, Mufti Mahmoodul Hasan Gangohi (\u0631\u062d\u0645\u0647 \u0627\u0644\u0644\u0647):<\/li>\n<\/ol>\n<p style=\"text-align: justify;\"><strong>Question:<\/strong><\/p>\n<p style=\"text-align: justify;\">The person who has missed a <em>rakat<\/em>, should he:<\/p>\n<ol style=\"text-align: justify;\">\n<li>Stand when the Imam, while turning his head to the right for the first <em>salaam<\/em>, has only said the word <em>salaam<\/em>,<\/li>\n<li>Stand while he is saying the <em>salaam<\/em> on the left side, or<\/li>\n<li>Stand when he has completed the <em>salaam<\/em> on the left side?<\/li>\n<\/ol>\n<p style=\"text-align: justify;\">Which method is best from these three?<\/p>\n<p style=\"text-align: justify;\"><strong>Answer:<\/strong><\/p>\n<p style=\"text-align: justify;\">The method in \u2018<strong>3<\/strong>\u2019 is the safest and best.<\/p>\n<p style=\"text-align: justify;\"><strong>And Allah knows best.<\/strong><\/p>\n<p style=\"text-align: justify;\">The slave Mahmood. Darul Uloom Deoband, 19\/2\/90 AH<\/p>\n<p style=\"text-align: justify;\">[<strong>Fatawa Mahmoodiyah<\/strong>]<a href=\"#_edn21\" name=\"_ednref21\">[21]<\/a><\/p>\n<ol style=\"text-align: justify;\" start=\"3\">\n<li>Hazrat Mufti Radhaul Haqq (\u062d\u0641\u0638\u0647 \u0627\u0644\u0644\u0647):<\/li>\n<\/ol>\n<p style=\"text-align: justify;\"><strong>Question:<\/strong><\/p>\n<p style=\"text-align: justify;\">\u00a0Will the <em>masbooq<\/em> stand after the first <em>salaam<\/em> of the Imam or the second?<\/p>\n<p style=\"text-align: justify;\"><strong>\u00a0<\/strong><strong>Answer:<\/strong><\/p>\n<p style=\"text-align: justify;\">The <em>masbooq<\/em> should stand up to complete his missed <em>rakaats<\/em> after he is sure that the Imam has completed his Salah and there is nothing remaining on him. This is <u>usually<\/u> known\u00a0<strong>after<\/strong> the <strong>second<\/strong> <em>salaam<\/em>.<\/p>\n<p style=\"text-align: justify;\">[<strong>Fatawa Darul Uloom Zakariyah<\/strong>]<a href=\"#_edn22\" name=\"_ednref22\">[22]<\/a><\/p>\n<p style=\"text-align: justify;\"><span style=\"color: #0000ff;\"><strong><u>Further Clarification:<\/u><\/strong><\/span><\/p>\n<p style=\"text-align: justify;\">By this statement \u2018This is usually know after the second salaam\u2019, Mufti sahib is indicating to the actual text of the <em>fuqahaa<\/em> who state that the <em>masbooq<\/em> should even wait a <strong>little <\/strong><strong>longer<\/strong><strong> after<\/strong> the second <em>salaam<\/em>.<\/p>\n<p style=\"text-align: justify;\">The Syrian critical-research scholar and Hanafi authority, Allamah Ibn Abideen Shaami (\u0631\u062d\u0645\u0647 \u0627\u0644\u0644\u0647) states, \u201cHe (the <em>masbooq<\/em>) will not stand after the first or second <em>salaam<\/em>, rather he will wait until the Imam is complete <strong>after<\/strong> both salaams. This is what is mentioned in the books \u2018Al-Faidh\u2019 \u2018Al-Fath\u2019 and \u2018Al-Bahr\u2019. Zandawaisti said in \u2018An-Nazm\u2019, \u2018He will wait until the Imam stands for his <em>nafl<\/em> Salah or he reclines in the <em>mihraab<\/em> if there are no <em>nafl<\/em> after the Fardh (Salah like in Fajr and Asr).\u2019 However, the author of Halbah said, \u2018This is not necessary. Rather the objective is whatever action indicates that there is no (<em>sajdah<\/em>) <em>sahw<\/em> on the Imam or the Imam does something which\u00a0breaks the Salah.\u2019\u201d<a href=\"#_edn23\" name=\"_ednref23\">[23]<\/a><\/p>\n<p style=\"text-align: justify;\">From this we see that the <em>fuqaha<\/em> have stated it is best to wait until one is certain that the Imam does not have to make a <em>sajdah-sahw<\/em>. Most times this is understood after he has completed the second <em>salaam<\/em>, while in other rare instances, it may take longer. For instance, if something unusual occurred in the Salah and the <em>masbooq <\/em>feels it might necessitate <em>sajdah-sahw<\/em>, but the Imam made both <em>salaams <\/em>and didn\u2019t do any <em>sajdah-sahw<\/em>. For instance, his period for <em>masah<\/em> (wiping) on his leather socks would end before the Imam makes the <em>salaam<\/em>.
