{"id":4311,"date":"2016-01-23T16:09:10","date_gmt":"2016-01-23T20:09:10","guid":{"rendered":"http:\/\/www.fiqhulislam.co\/?p=4311"},"modified":"2016-01-23T16:09:10","modified_gmt":"2016-01-23T20:09:10","slug":"bathing-naked","status":"publish","type":"post","link":"https:\/\/www.fiqhulislam.com\/?p=4311","title":{"rendered":"Bathing Naked"},"content":{"rendered":"<p style=\"text-align: center;\">\u0628\u0633\u0645 \u0627\u0644\u0644\u0647 \u0627\u0644\u0631\u062d\u0645\u0646 \u0627\u0644\u0631\u062d\u064a\u0645<\/p>\n<p style=\"text-align: justify;\">Imam Bukhari (\u0631\u062d\u0645\u0647 \u0627\u0644\u0644\u0647) explains the ruling of this mas\u2019alah beautifully in his \u201cSaheeh\u201d.<\/p>\n<p style=\"text-align: justify;\">There are two scenarios:<\/p>\n<ol style=\"text-align: justify;\">\n<li>A person is in an area where others can see him<\/li>\n<li>A person is alone in seclusion where no one can see him<\/li>\n<\/ol>\n<p style=\"text-align: justify;\">For the first case, it is\u00a0<strong>compulsory<\/strong>\u00a0to screen oneself while taking a bath. Imam Bukhari (\u0631\u062d\u0645\u0647 \u0627\u0644\u0644\u0647) explains this under the title:<\/p>\n<p style=\"text-align: justify;\">\u201cChapter: To screen oneself while taking a bath around people:<\/p>\n<ul style=\"text-align: justify;\">\n<li>Umm Hani bint Abi Talib (\u0631\u0636\u064a \u0627\u0644\u0644\u0647 \u0639\u0646\u0647\u0627) said: \u201cI went to Allah&#8217;s Messenger (\ufdfa) in the year of the conquest of Mecca and found him taking a bath while Fatima was screening him.\u201d<a href=\"#_ftn1\" name=\"_ftnref1\">[1]<\/a><\/li>\n<\/ul>\n<p style=\"text-align: justify;\">Ibn Battal said, the scholars of fatwa all agree that, if a person was to enter a public bath naked, that he is sinful and he will no longer be considered a reliable, upright person. Therefore, any testimony he gives in an Islamic court of law would be rejected.<a href=\"#_ftn2\" name=\"_ftnref2\">[2]<\/a><\/p>\n<p style=\"text-align: justify;\">As for the second case, Imam Bukhari (\u0631\u062d\u0645\u0647 \u0627\u0644\u0644\u0647) explains it in the following manner:<\/p>\n<p style=\"text-align: justify;\">\u201cChapter: Whosoever took a bath naked alone in seclusion, but whoever conceals himself then concealment is better. The Messenger said: \u201cAllah is more deserving that you should feel shy before Him than people.\u201d<\/p>\n<p style=\"text-align: justify;\">Thereafter Imam Bukhari mentioned two hadiths of the Rasool (\ufdfa) where he related that two Prophets of the past bathed naked when in seclusion.<a href=\"#_ftn3\" name=\"_ftnref3\">[3]<\/a>\u00a0After relating these stories the Messenger (\ufdfa) remained silent, which shows that bathing naked when in seclusion is\u00a0<strong>allowed<\/strong>\u00a0in this Shariah as well. However, Imam Bukhari indicates that concealing oneself with a lower garment etc. even when in seclusion is best and part of hayaa and modesty.<a href=\"#_ftn4\" name=\"_ftnref4\">[4]<\/a>\u00a0<strong>Hayaa is, after all, an integral part of our Imaan.\u00a0<\/strong>The hadith which\u00a0Bukhari indicated to is collected in full by Imam Abu Dawud (\u0631\u062d\u0645\u0647 \u0627\u0644\u0644\u0647) in his \u2018Sunan\u2019:<\/p>\n<p style=\"text-align: justify;\">&#8220;It was narrated from Bahz\u00a0bin Hakim, from his father that his\u00a0grandfather said: &#8220;I said: &#8216;O\u00a0Messenger of Allah, with regard to\u00a0our &#8216;awrah, what may we uncover\u00a0of it and what must we conceal?&#8217;\u00a0He said: &#8216;Cover your &#8216;awrah\u00a0(completely) except from your wife\u00a0and those whom your right hand\u00a0possesses.&#8217; I said, &#8216;O\u00a0Messenger of\u00a0Allah, what if the people live close\u00a0together?&#8217; He said, &#8216;If you can\u00a0make sure that no one sees it, then\u00a0do not let anyone see it.&#8217; I said, &#8216;O\u00a0Messenger of Allah, what if one of\u00a0us is alone?&#8217; He said, &#8216;Allah is\u00a0more deserving that you should\u00a0feel shy before Him than people.'&#8221;<a href=\"#_ftn5\" name=\"_ftnref5\">[5]<\/a><\/p>\n<p style=\"text-align: justify;\">Furthermore, under the first chapter mentioned above, entitled, \u201cTo screen oneself while taking a bath around people\u201d, Imam Bukhari had also mentioned a second hadith narrated by Ibn Abbas, who said that Maimunah (\u0631\u0636\u064a \u0627\u0644\u0644\u0647 \u0639\u0646\u0647\u0645\u0627) said: \u201cI screened the Prophet (\ufdfa) while he was taking a bath of major ritual impurity (janabah).\u201d<a href=\"#_ftn6\" name=\"_ftnref6\">[6]<\/a><\/p>\n<p style=\"text-align: justify;\">Maimunah (\u0631\u0636\u064a \u0627\u0644\u0644\u0647 \u0639\u0646\u0647\u0627) is one of the \u2018Mothers of the Believer\u2019 and an honourable wife of the Messenger of Allah (\ufdfa), yet he had himself screened.<a href=\"#_ftn7\" name=\"_ftnref7\">[7]<\/a> Hazrat Shaikh, Maulana Muhammad Zakariyah Kandhalvi (\u0631\u062d\u0645\u0647 \u0627\u0644\u0644\u0647) said, that by this chapter Imam Bukhari (\u0639\u0644\u064a\u0647 \u0627\u0644\u0631\u062d\u0645\u0629) is stating that, even if a person is bathing with a lower garment on, it is still best to conceal his-self with another screen.<a href=\"#_ftn8\" name=\"_ftnref8\">[8]<\/a><a href=\"#_ftn9\" name=\"_ftnref9\">[9]<\/a><a href=\"#_ftn10\" name=\"_ftnref10\">[10]<\/a><\/p>\n<p style=\"text-align: justify;\">Even though our clothing does not prevent Allah from seeing below it, walking around naked is abandoning an etiquette that we should adopt in front of Allah.<a href=\"#_ftn11\" name=\"_ftnref11\">[11]<\/a><\/p>\n<p style=\"text-align: justify;\">In his commentary of Mishkaat,\u00a0Mulla Ali Qari\u00a0(\u0631\u062d\u0645\u0647 \u0627\u0644\u0644\u0647) quotes\u00a0Ibn Hajr Makki&#8217;s (\u0631\u062d\u0645\u0647 \u0627\u0644\u0644\u0647) summary on\u00a0this issue:<\/p>\n<p style=\"text-align: justify;\">\u201c<strong>The summary of the ruling for the one who takes a bath naked is<\/strong>:<\/p>\n<ul style=\"text-align: justify;\">\n<li>If he is in a secluded place where no such person, upon whom it is haram to look at his awrah, can see him, then it (bathing naked) is permissible for him. However, it is more virtuous to conceal oneself out of shame in front of Allah.<\/li>\n<li>If he is in a place where such a person, upon whom it is prohibited to look at his awrah, can see him, then it is compulsory to screen himself by the consensus of the scholars.\u201d<a href=\"#_ftn12\" name=\"_ftnref12\">[12]<\/a><\/li>\n<\/ul>\n<p style=\"text-align: center;\"><span style=\"text-decoration: underline;\"><strong>Fatawa Al-Akabir<\/strong><\/span><\/p>\n<ol>\n<li style=\"text-align: justify;\">Mufti Azam Azizur Rahman said: \u201cIf the walls of the bathroom are very high and there is no possibility of being exposed, then it is permissible to take a bath naked even if there is no roof. However, it is better not to bathe naked.\u201d \u2018Fatawa Darul Uloom Deoband Qadeem\u2019 (Vol.1 Pg.130) He also said: \u201cTaking a bath naked in a secluded place is permissible. Where there are people then tie a cloth from one\u2019s navel to knee and bathe.\u201d Ibid \u201cQuestion: Is it permissible to take a bath in an enclosed place without a lower garment? Answer: It is permissible to take a bath naked in such places.\u201d Ibid.<\/li>\n<li style=\"text-align: justify;\">Faqeehul Ummah said: \u201cTo bathe naked in a secluded place is established from the Prophet. This hadith is in Bukhari and Muslim.\u201d \u2018Fatawa Mahmoodiyah\u2019 (Vol.28 Pg.115). He also said: \u201cWhen there is a partition and no one is looking, then it is permissible for all (males and females) to shower naked.\u201d \u2018Fatawa Mahmoodiyah\u2019 (Vol.28 Pg.117)<\/li>\n<li style=\"text-align: justify;\">Mufti Maulana Yusuf Ludhyanvi said: \u201cIt is permissible to take off one\u2019s clothing and take a bath in an enclosed place. It is better to sit and take a bath in this situation.\u201d \u2018Aap ke Masail aur unka Hall\u2019 (Vol.3 Pg.107) He also said: \u201cIt is permissible (for a male and female to take a bath naked) once no one is looking.\u201d Ibid (Vol.3 Pg.119)<\/li>\n<li style=\"text-align: justify;\">Mufti Rasheed Ahmed Ludhyanvi said: \u201cIt is permissible to take a bath in a bathroom that does not have a roof, rather (it is also permissible to take a bath) in an open area, once one is alone. However, it is better to have a partition on all four sides. There is no need for a roof [unless someone can see from above. Translator\u2019s note] The Messenger took a bath by erecting four walls of cloths, instead of wearing one. From this, it is established that it is better to take a bath behind a partition than (to take one in the open) with a lungi etc. on.\u201d \u2018Ahsanul Fatawa\u2019 (Vol.2 Pg.31-32) He also said: \u201cIt is best to sit and take a bath because there is more concealment in it. From the narrations, it can be gathered that the Messenger sat and took a bath.\u201d \u2018Ahsanul Fatawa\u2019 (Vol.2 Pg.5)<\/li>\n<li style=\"text-align: justify;\">Mufti Fareed said: \u201cIt is permissible to bath naked, however, it is best to use a lower garment.\u201d \u2018Fatawa Faridiyah\u2019 (Vol.2 Pg.64) He also said: \u201cIt should be clear that a person shold take a bath where he is alone. Even then, he should refrain from exposing his awrah. The leeway of exposing one\u2019s awrah is based on the need. If there are people present there, then it is fardh on the male to cover his awrah from navel to knee.\u201d \u2018Fatawa Faridiyah\u2019 (Vol.2 Pg.72)<\/li>\n<li style=\"text-align: justify;\">Mufti Muhammad Taqi Usmani said: \u201cIt is best to tie a cloth and take a bath. However, it is permissible without any reprehensibility to bathe naked once there is full arrangements of a partition.\u201d The answer is correct. Mufti Muhammad Ashiq Ilahi. \u2018Fatawa Usmani\u2019 (Vol.1 Pg.315)<\/li>\n<li style=\"text-align: justify;\">Mufti Rafi Usmani said: \u201cThere is a leeway to take a bath naked in a closed bathroom. However, it is better to tie a lower garment etc.\u201d \u2018Imdadus Saileen\u2019 (Vol.1 Pg.516)<\/li>\n<li style=\"text-align: justify;\">Mufti Maulana Khalid Saifullah said: \u201cThe best method is that one should not become completely naked at the time of a bath. It is best to conceal ones private parts with a cloth. However, if someone takes a bath naked in an enclosed place, then there is no sin. There is nothing in the Quran or Hadith which states that one\u2019s home would be deprived of blessings if one takes a bath naked.\u201d \u2018Kitabul Fatawa\u2019 (Vol.2 Pg.61) He also said: \u201cA person should always try as much as possible to remain concealed. However, this ruling is one of caution and istihbab. In two cases, concealing one\u2019s awrah is wajib. One, is in salah and two, is when people are looking. Therefore if while performing wudhu or ghusl, one\u2019s awrah was exposed a little and no one was looking, then there is no problem.\u201d \u2018Kitabul Fatawa\u2019 (Vol.2 Pg.60)<\/li>\n<\/ol>\n<p style=\"text-align: center;\"><strong>\u0648\u0627\u0644\u0644\u0647 \u0627\u0639\u0644\u0645<\/strong><\/p>\n<hr \/>\n<p style=\"text-align: justify;\"><a href=\"#_ftnref1\" name=\"_ftn1\">[1]<\/a> Saheeh Bukhari Chapter 21 Hadith #280<\/p>\n<p style=\"text-align: justify;\"><a href=\"#_ftnref2\" name=\"_ftn2\">[2]<\/a> Sharh Ibn Battal Vol.1 Pg.396, Thereafter he named, Abu Hanifah, his students, Malik, Thawri, and Shafee (\u0631\u062d\u0645\u0647\u0645 \u0627\u0644\u0644\u0647), At-Tawdheeh Vol.4 Pg.639, Umdatul Qari Vol.3 Pg.346<\/p>\n<p style=\"text-align: justify;\"><a href=\"#_ftnref3\" name=\"_ftn3\">[3]<\/a> Saheeh Bukhari Chapter 20 Hadith #278 &amp; #279<\/p>\n<p style=\"text-align: justify;\"><a href=\"#_ftnref4\" name=\"_ftn4\">[4]<\/a> Imam Nawawi states, \u201cThe Ulama say, to conceal oneself with a lower garment etc. while taking a bath in seclusion is better than revealing oneself.\u201d See \u2018Al-Minhaaj Sharh Muslim\u2019 (Vol.4 Pg.32)<\/p>\n<p style=\"text-align: justify;\"><a href=\"#_ftnref5\" name=\"_ftn5\">[5]<\/a> Sunan Abu Dawud, Chapter Regarding Nudity #4017, Tirmithi # 2769. He classified is as hasan.<\/p>\n<p style=\"text-align: justify;\"><a href=\"#_ftnref6\" name=\"_ftn6\">[6]<\/a> Saheeh Bukhari Chapter 21 Hadith #281<\/p>\n<p style=\"text-align: justify;\"><a href=\"#_ftnref7\" name=\"_ftn7\">[7]<\/a> See Fathul Baari of Ibn Rajab Hanbali Vol.1 Pg.333-334<\/p>\n<p style=\"text-align: justify;\"><a href=\"#_ftnref8\" name=\"_ftn8\">[8]<\/a> Al-Abwaab wat Tarajim Vol.1 Pg.62<\/p>\n<p style=\"text-align: justify;\"><a href=\"#_ftnref9\" name=\"_ftn9\">[9]<\/a> On the other hand, Allamah Anwar Shah Kashmiri was of the opinion that, concealing oneself in an unoccupied place outside, is required. However, if a person is positive that others will not pass by and see him, then there is no problem in bathing naked. As for nowadays with private bathrooms in the homes, then there is no problem in bathing naked. See \u2018Faidhul Bari\u2019 (Vol.1 Pg.469). The muhaddith, Hazrat Maulana Rasheed Ahmed Gangohi has indicated that this is also a possible meaning of reconciling between the ahadith. See \u2018Al-Abwaab wat Tarajim\u2019 Vol.1 Pg.62 \u0648\u0627\u0644\u0644\u0647 \u0627\u0639\u0644\u0645<\/p>\n<p style=\"text-align: justify;\"><a href=\"#_ftnref10\" name=\"_ftn10\">[10]<\/a> Hafiz Ibn Battal says: \u201cThe fuqaha state that covering oneself in seclusion is mustahab, not wajib.\u201d Sharh Ibn Battal on Saheeh Bukhari Vol.1 Pg.395, Tawdheeh by Ibn Mulaqqin Vol.4 Pg.622, Tuhfatul Qari by Idris Kandhalvi Vol.1 Pg.109. However, some Hanafis and Shafees consider it wajib to cover ones awrah even in seclusion unless there is a valid reason to expose it. See \u2018Al-Mihaj\u2019 by Nawawi (Vol.4 Pg.32), \u2018Al-Kawakib Ad-Darari\u2019 by Kirmani (Vol.3 Pg.140), \u2018Al-Kawthar Jari\u2019 by Al-Kurani (Vol.1 Pg.468), \u2018Al-Bahrur Raiq\u2019 by Ibn Nujaim (Vol.1 Pg.468), \u2018An-Nahrul Faiq\u2019 (Vol.1 Pg.182), \u2018Raddul Muhtaar\u2019 by Ibn Abideen (Vol.2 Pg.93), \u2018Tawaliul Anwaar\u2019 by Al-Sindhi (Vol.1 Pg.522), \u2018Fathul Mulhim by Usmani (Vol.3 Pg.142). Siddique Hasan Bhopali was also of this opinion, see his \u2018Al-Siraj Wahhaj\u2019 (Vol.2 Pg.22). (\u0631\u062f \u0627\u0644\u0645\u062d\u062a\u0627\u0631)<\/strong><\/p>\n<p style=\"text-align: justify;\">Ibn Hajr Asqalani states that, the famous opinion amongst the earlier Shafee scholars, like others, is that it is only makrooh to reveal oneself in seclusion without a valid reason. See \u2018Fathul Bari\u2019 (Vol.1 Pg.655). The following is in \u2018Fatawa Mahmoodiyah\u2019: \u201cQuestion: Zaid exercises. However, his awrah remains exposed. He simply has on briefs. He is in seclusion when exercising. What is the ruling on this? Answer: It is not prohibited to exercise in this manner in seclusion. (However) it would not be permissible to come in front of people with his awrah exposed in this manner. And Allah knows best.
