Take for example listening to the radio. Women read the news. Should this be listened to? The flawed analogy of some will no doubt be that Sahabah (May Allah Ta\u2019ala Be Pleased With Them) would ask Hadhrat A\u2019isha Radiallahu Anha rulings &amp; learn from her, thus legitimising the presence of female presenters on so-called Islamic radio stations. Is this justified? When can a non mahram woman\u2019s voice be listened to? What would constitute necessity?<\/p>\n<p style=\"text-align: justify;\"><strong>\u00a0<\/strong><strong>Answer:<\/strong><\/p>\n<p style=\"text-align: justify;\"><strong>In the Name of Allah, the Most Gracious, the Most Merciful.<\/strong><\/p>\n<p style=\"text-align: justify;\"><strong>As-sal\u0101mu \u2018alaykum wa-rahmatull\u0101hi wa-barak\u0101tuh.<\/strong><\/p>\n<p style=\"text-align: justify;\">Allah Ta\u2019\u0101 la has created the female voice naturally attractive and placed in it the ability to arouse and incite passion in men. This is a reality which cannot be denied. You are not like any other women. If you fear Allah, then do not be soft in speech, lest he in whose heart is a disease (of hypocrisy or evil desire for adultery, etc.) should be moved with lust.\u201d (Surah al-Ahzab: 32)<\/p>\n<p style=\"text-align: justify;\">Allah Ta\u2019\u0101 la, the Creator, being fully aware of the propensities of all things he has created, commands that women exercise hijab on their voices as well, even when there is a need to speak, they should not speak to men in soft and tender tones.<\/p>\n<p style=\"text-align: justify;\">It has been narrated from some of the wives of the Messenger of Allah (Allah bless him and give him peace) that, after the revelation of the above mentioned verse, when the need arose for them to converse with a non-Mahram male, they would do so by placing their hands over their mouths. This was to prevent any softness or incitement in their voices. (Hadith recorded by Darqutni in his Sunan with an authentic chain of narrators).<\/p>\n<p style=\"text-align: justify;\">The great Hanafi scholar Imam Abu Bakr al-Jassas says in his Ahkam al-Qur\u2019an (his excellent work on the verses of the Qur\u2019an relating to law):<\/p>\n<p style=\"text-align: justify;\">\u201cThis verse (above-mentioned) indicates the impermissibility of women raising their voices in the presence of non-Mahram males, as this may lead to Fitna. This is why our (Hanafi) scholars have declared the calling of Adhan for women as Makruh, as she will need to raise her voice, which is not permissible.\u201d (Ahkam al-Qur\u2019an, 5\/229)<\/p>\n<p style=\"text-align: justify;\"><strong>The ruling regarding the voice of a woman.<\/strong><\/p>\n<p style=\"text-align: justify;\">The ruling regarding the voice of a woman will be based on whether her voice is part of her <em>Awra<\/em> or not. (<em>Awra is that part of a female that must be concealed from Ghair Mahram men)<\/em>.<\/p>\n<p style=\"text-align: justify;\">Among the Fuqaha there is a difference of opinion regarding a woman\u2019s voice being part of her Awra or not. The classical Hanafi view is that it <strong>is<\/strong> <strong>part<\/strong> of her Awra. You are not like any other women. If you keep you fear Allah, then do not be soft in speech, lest he in whose heart is a disease (of hypocrisy, or evil desire for adultery, etc.) should be moved with lust.\u201d (Surah al-Ahzab: 32)<\/p>\n<ul style=\"text-align: justify;\">\n<li>Allah Ta\u2019\u0101 la says: \u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u0648\u064e\u0644\u064e\u0627 \u064a\u064e\u0636\u06e1\u0631\u0650\u0628\u06e1\u0646\u064e \u0628\u0650\u0623\u064e\u0631\u06e1\u062c\u064f\u0644\u0650\u0647\u0650\u0646\u0651\u064e \u0644\u0650\u064a\u064f\u0639\u06e1\u0644\u064e\u0645\u064e \u0645\u064e\u0627 \u064a\u064f\u062e\u06e1\u0641\u0650\u064a\u0646\u064e \u0645\u0650\u0646 \u0632\u0650\u064a\u0646\u064e\u062a\u0650\u0647\u0650\u0646\u0651\u064e\u06da<\/li>\n<\/ul>\n<p style=\"text-align: justify;\">\u201cAnd let them not stamp their feet so as to reveal what they hide of their adornment.\u201d (Surah an-Noor: 31).<\/p>\n<p style=\"text-align: justify;\">Putting something in the jewellery or adornment so that it produces a sound, or making of sounds by the knocking of adornments with each other, or putting the feet on the ground in such a manner that the adornments make a sound, and the non-Mahrams listen to these sounds; they are all prohibited under the provision of this verse. In the light of this explanation many jurists have drawn the conclusion that if making the adornment\u2019s sound heard is prohibited, then to cause a women\u2019s own voice to be heard would be prohibited even more strongly (as there is stronger fitnah in this). Therefore, they have ruled that the voice of women is also included in their Awrah.\u00a0\u00a0 ( MaarifulQuraan by Mufti Shafi Usmani 6\/417)<a href=\"http:\/\/fatwa-tt.com\/2015\/03\/13\/is-a-non-mahram-females-voice-meant-not-to-be-heard-by-males-awrah\/#_ftn1\" name=\"_ftnref1\">[1]<\/a><\/p>\n<ul style=\"text-align: justify;\">\n<li>Women are not permitted to recite Quraan audibly in Salah.<\/li>\n<li>Women are not permitted to rectify the Imam\u2019s error by loudly reciting \u201cSubhanallah\u201d as men are ordered to do. Rather they should clap the fingers of the right hand on the back of the left hand.<\/li>\n<li>It is not proper for young women to say even \u201cAssalamu-alaikum\u201d to Ghair Mahram males.<\/li>\n<li>Neither Azan nor Iqamah has been ordered for them; a woman cannot be a Muazzin.<\/li>\n<li>They are not allowed to recite theTalbiyah (Labbaik\u2026..) aloud during Hajj.\u00a0\u00a0 \u00a0 \u00a0 \u00a0 \u00a0 \u00a0 <a href=\"http:\/\/fatwa-tt.com\/2015\/03\/13\/is-a-non-mahram-females-voice-meant-not-to-be-heard-by-males-awrah\/#_ftn2\" name=\"_ftnref2\">[2]<\/a><\/li>\n<\/ul>\n<p style=\"text-align: justify;\">The latter-day Hanafi Fuqaha<a href=\"http:\/\/fatwa-tt.com\/2015\/03\/13\/is-a-non-mahram-females-voice-meant-not-to-be-heard-by-males-awrah\/#_ftn3\" name=\"_ftnref3\">[3]<\/a> (<em>and Imam Shafi rahimhullah<a href=\"http:\/\/fatwa-tt.com\/2015\/03\/13\/is-a-non-mahram-females-voice-meant-not-to-be-heard-by-males-awrah\/#_ftn4\" name=\"_ftnref4\"><strong>[4]<\/strong><\/a><\/em>) have stated that a woman\u2019s voice is\u00a0<strong>not part<\/strong> of her Awra, provided that there is no fear of Fitna (temptation). This means that a male may listen to the voice of a female if he needs to; however, if there is a fear of Fitna, then the female should not raise it and the male should avoid listening to it. This is the preferred opinion, on the condition that there is no temptation, lust or wicked intentions involved in listening. You are not like any other women. If you fear Allah, then do not be soft in speech, lest he in whose heart is a disease (of hypocrisy or evil desire for adultery, etc.) should be moved with lust.\u201d (Surah al-Ahzab: 32)<\/p>\n<p style=\"text-align: justify;\">Allah Ta\u2019\u0101 la mentions the condition for prohibition as: (do not be soft in speech, lest he in whose heart is a disease should be moved with lust.) So if the condition for prohibition does not exist then there is no prohibition.<\/p>\n<ul style=\"text-align: justify;\">\n<li>One of the great Hanafi Fuqaha, Ibn Abidin ash-Shami, says:<\/li>\n<\/ul>\n<p style=\"text-align: justify;\">\u201cIt is permissible for women to converse with non-Mahram men at the time of need (and vice versa). However, what is not permissible is that they stretch, soften and raise their voice in a melodious way.\u201d (Radd al-Muhtar, 1\/406)<\/p>\n<ul style=\"text-align: justify;\">\n<li>Wahaba al-Zuhayli writes in his famous al-Fiqh al-Islami wa Adillatuhu:<\/li>\n<\/ul>\n<p style=\"text-align: justify;\">According to the majority of the scholars, a woman\u2019s voice is not part of her Awra .., but it is unlawful (haram) to listen to the voice of a female which is in a melodious and musical tone, even if it is by reciting Qur\u2019an, because of the fear of fitna. (1\/755)<a href=\"http:\/\/fatwa-tt.com\/2015\/03\/13\/is-a-non-mahram-females-voice-meant-not-to-be-heard-by-males-awrah\/#_ftn5\" name=\"_ftnref5\">[5]<\/a><\/p>\n<ul style=\"text-align: justify;\">\n<li>Mufti Shafi Usmani mentions in his famous Maariful Quraan under the commentary of the Ayah:<\/li>\n<\/ul>\n<p style=\"text-align: center;\">\u0648\u064e\u0644\u064e\u0627 \u064a\u064e\u0636\u06e1\u0631\u0650\u0628\u06e1\u0646\u064e \u0628\u0650\u0623\u064e\u0631\u06e1\u062c\u064f\u0644\u0650\u0647\u0650\u0646\u0651\u064e \u0644\u0650\u064a\u064f\u0639\u06e1\u0644\u064e\u0645\u064e \u0645\u064e\u0627 \u064a\u064f\u062e\u06e1\u0641\u0650\u064a\u0646\u064e \u0645\u0650\u0646 \u0632\u0650\u064a\u0646\u064e\u062a\u0650\u0647\u0650\u0646\u0651\u064e\u06da<\/p>\n<p style=\"text-align: justify;\">\u201cAnd let them not stamp their feet so as to reveal what they hide of their adornment.\u201d (Surah an-Noor: 31) <strong>:<\/strong><\/p>\n<p style=\"text-align: justify;\"><strong>The issue of women\u2019s voice<\/strong><\/p>\n<p style=\"text-align: justify;\">Is women\u2019s voice included in their Awra per se, and is causing it to be heard by non-Mahrams prohibited?<\/p>\n<p style=\"text-align: justify;\">The jurists differ on this issue. In the books of Imam Shafi\u2019 rahimahullah, the voice of women is not included in their Awra. In the case of Hanafi there are different views. Ibn Humam rahimahullah, has included the voice in satr on the basis of statements in Nawazil. Because of this theAzaan by women is regarded Makroof by the Hanafi School. However, it is established by hadith that the wives of the Holy Prophet \ufdfa used to talk to non-Mahrams from behind the curtain even after the revelation of injunction of Hijaab. Keeping in view all the material on this point, what seems to be the correct position is that hearing the voice of a woman is impermissible only when and where it may create a fitnah, but where there is no such apprehension, it is allowed. However, the prudent way for women is to take care and avoid talking to non-Mahrams, even from behind the curtains, unless necessary. {End quote, Maariful Quraan, 6 \/416-417}<\/p>\n<p style=\"text-align: justify;\">The above quotations indicate that a woman\u2019s voice is not part of her Awra. However, it will not be permissible for her to raise her voice in a melodious, tempting soft or sweet way, and a man will only be allowed to listen to her if there is no fear of Fitna or lust. When a woman sings or raises her voice in a melodious seducing way, it then becomes part of her Awra which must be concealed from GhairMahram men.<\/p>\n<p style=\"text-align: justify;\">Based on the aforementioned and also bearing in mind the extreme levels of Fitna prevalent in these times, and knowing that the female presenters on-air try to \u2018exhibit\u2019 their voices in a most enchanting manner, it is better to refrain from listening to these women. However if one needs to listen to the news and his intention is pure, then he may listen to it, with the condition that there is no fear of Fitna or lust and no incitement in her voice. As for speaking and interacting with a Ghair-Mahram, we must refrain from this as much as possible and must only be done when necessary.
